Approving and authorizing a five year Use and Lease Agreement, effective May 1, 2009, with Signatory Airlines at Kansas City International Airport; authorizing like agreements with additional airlines; and authorizing amendments to the agreements.


TRANSPORTATION AND INFRASTRUCTURE COMMITTEE recommends "DO PASS"
Mark VanLoh, Aviation Department, explained the purpose of this ordinance and answered questions from the committee. No public testimony. This ordinance will authorize the execution of the Airport Use and Lease Agreement with Signatory Airlines expected to enter into new use and lease agreements with the Airport and allay the necessity of enacting individual ordinances for each airline that has an existing relationship with the Airport. The terms and conditions of the Use and Lease Agreement are identical with each airline except for the defined space for each airline which is identified in Exhibit “C” of the Agreement. The Director is also authorized to execute this same Airport Use and Lease Agreement, during its term, with any additional airline that agrees to the terms and conditions of the Airport Use and Lease Agreement.

Authorizing the Director of General Services to execute documents and take all steps necessary to effectuate a purchase with Pursell Oxford Investments, LLC, for the purchase of the 25 +/- acre tract at approximately 9600 Elmwood (the “Property”) for the Kansas City, Missouri, Police Department-South Patrol, out of previously appropriated funds; and recognizing an emergency.

Gerald Smith General Services, explained the purpose of this ordinance. Councilwoman Cindy Circo testified in support of this ordinance. No public testimony. This ordinance authorizes the director of General Services to contract for the purchase of the South Patrol Land, noted in Ordinance 090263.

Reducing appropriations in the Capital Improvements Fund in the amount of $65,000.00 and appropriating this sum to an account in the Capital Improvements Fund for a project in the Fifth Council District; reducing appropriations in the General Fund in the amount of $65,000.00 and appropriating this sum to an account in the General Fund for projects in the Fifth Council District.

Patrick Klein, Budget Office, explained the purpose of this ordinance and answered questions from the committee. Councilwoman Cindy Circo testified in support of the ordinance. No public testimony. This ordinance will allow planning work to begin to the Council District 5 wireless initiative and the MCI site pre-development. By using CIP Council District 5 neighborhood sales tax for street preservation, this allows general fund dollars to fund the planning effort for these two projects.

RESOLUTION - Stating the intention of the Council regarding advance funding of certain capital projects


TRANSPORTATION AND INFRASTRUCTURE COMMITTEE recommends "IMMEDIATE ADOPTION AS A COMMITTEE SUBSTITUTE"
Councilman Russ Johnson commented on the need for Kansas City own stimulus program for infrastructure and testified in support of this resolution. Patrick Klein, Budget Office, explained the purpose of this resolution. Randy Landes, Finance Department, testified in support of the resolution and answered questions from the committee. No public testimony. This resolution will allow the Mayor and City Council to advance fund projects within the Adopted 5-Yr CIP. Advancement of funds are limited to the amount programmed in the 5-Yr and have been bid.
