Approving and authorizing settlement of a condemnation lawsuit styled City of Kansas City, Mo. v. KC Benjamin, LLC, et al., Case No. 1516-CV02035; estimating revenue of $471,000.00 in the Legal Claims Fund; appropriating $471,000.00 from the Unappropriated Fund Balance of the Legal Claims Fund; and recognizing this ordinance as having an accelerated effective date.

Galen Beaufort, Law Department testified funds will be used to pay the settlement reached to resolve the pending condemnation case styled: City of KC, Mo. v. K.C. Benjamin LLC, et al. (1516-CV02035), and to pay expenses related to this condemnation case. This ordinance also authorizes the settlement of this condemnation case.

Declaring certain City-owned real property generally located within the southwestern portion of 1901 American Royal Drive, lying to the north of the confluence of State Line Road and American Royal Drive, surplus to the City’s needs and no longer needed for public use; authorizing the Director of General Services to execute the necessary documents or agreement to sell the property to Livestock Exchange LLC, consistent with the Lease Agreement between the City and Livestock Exchange LLC dated June 1, 2012; and to amend such Lease for the remaining property.

Vanessa Williams, General Services, and Mary McIntyre, Law Department, testified that this ordinance would allow the City to declare certain City-owned real property as surplus to the City’s needs and no longer needed for public use. The property is generally located within the southwestern portion of 1901 American Royal Drive, lying to the north of the confluence of State Line Road and American Royal Drive, and includes an .004 acres that were contingent upon the fulfilment of lease obligations.This Ordinance is needed in order for the City to fulfill its contractual obligations under the Lease and to document of record the authorization to transfer the first of two parcels, and to continue the Lease on the second of two parcels, and authorize the future exercise of the option to purchase on the second parcel.

 1. Finance Department staff will present the 2017-2022 Citywide Business Plan.
 
 Scott Huizenga, Finance Department, testified that the Citywide Business Plan will be presented to the entire Council tomorrow. This preview includes the components and objectives of the plan. The planning model provides the baseline for the Annual Budget. A copy of the presentation is on file with the City Clerk's Office.
 
 2. There may be a general discussion regarding current Finance and Governance Committee issues.
 
 3. Pursuant to the following subsections of Section 610.021 of the Revised Statutes of Missouri, there may be a closed session to discuss: (1) legal matters, litigation, or privileged communications with attorneys, pursuant to subsection 1; (2) real estate, pursuant to subsection 2; (3) personnel, pursuant to subsection 3 and 13; and/or (4) sealed bids or proposals, pursuant to subsection 12.
