Galen Beaufort, City Attorney, testified that this ordinance would appropriate revenue of $6,000 from the Unappropriated Fund Balance of the General Fund to the Law Department for services and expenses related to a property commonly known as 9251 Hillcrest Rd. Recently, per an agreement with Cerner Property Development Inc., the City received a check totaling $6,000.00 as a fourth installment payment, of which all is needed to be available for the payment of related miscellaneous legal expenses.

Appropriating $320,000.00 from the Unappropriated Fund Balance of the Development Services Fund to finance the acquisition of City Planning and Development vehicles; and designating requisitioning authority.


FINANCE AND GOVERNANCE COMMITTEE recommends "ADVANCE AND DO PASS AS A COMMITTEE SUBSTITUTE, DEBATE"
Jeff Williams, City Planning & Development, testified that this ordinance would authorize and finance a project to replace ten City Planning and Development Department vehicles. The finance will be done in one draw upon the Master Lease Purchase Agreement between the City and Bank of America Public Capital Corporation ("BAPCC") for the purpose of acquiring City Fleet Vehicles in an amount not to exceed $ 325,000.00. The lease term is expected to not exceed more than a eight (8) year period. Debt service funds are budgeted in the Development Services fund (2210) for replacement.

Reducing the Contingent Appropriation of the General Fund by $160,417.00; appropriating that same amount to the Indigent Court Defense account of the General Fund; and authorizing the Administrator of the Municipal Court to execute a one-year $1,240,417.00 contract extension with Legal Aid of Western Missouri for the legal representation of indigent defendants in Kansas City Municipal Court.

Megan Pfannenstiel, Court Administrator for Municipal Court, and Gregg Lombardi, Executive Director for Legal Aid of Western Missouri, testified that this ordinance would authorize and approve the annual appropriation for Legal Aid contract. For more than 20 years, the City has had a contract with Legal Aid of Western Missouri to represent low-income people who are charged with jailable offenses in Municipal Court . The City is required to provide free counsel to these defendants under the U.S. Supreme Court's decision in Gideon v. Wainright.
