Authorizing amendment of a three year lease agreement with Kansas City Sports Enterprises, Inc., for the performance of professional indoor soccer games at Kemper Arena authorizing the assignment of the lease agreement to the Major Indoor Soccer League, LLC.

Authorizing Farm Lease Agreements between Kansas City, Missouri and Glen and Karlyn Wren, Arsene Vandendaele, and Daniel and Bonita Sissom providing for lease for use in agricultural purposes portions of land at the Birmingham Farm located in Kansas City, Missouri.

Frank Pogge, Water Services Department, stated this ordinance would authorize Five Farm Lease Agreements. These are specialize leases for farmers to participate in our Bio-Solids Application Program at the Birmingham Land Application Site. Bio-Solids is the current term for Sewage Sludge that has been prepared in accordance with the EPA criteria and can be land applied and used as fertilizer. The farmers agree to utilize the sludge and to plant crops as indicate by the Department of Natural Land Resources. This allow us to dispose of five to six thousand of dried tons of sludge on an annual basis.

Amending Chapter 18, Code of Ordinances, by repealing Sections 18-14 through 18-16, 18-20, 18-324 through 18-340, and 18-343, and enacting in lieu thereof new sections of like numbers and subject matters, and deleting Sections 18-288 through 18-307, change in contractor licensing from two year renewal to a three year renewal basis and raising the renewal fee.

Barry Archer, Codes & Adminstration Department, stated this ordinance would make adminstration changes to Article I and II of the Kansas City Building Rehabilitation Code. The purpose for the adminstration changes is to allow for a three year renewal rather than the two current renewals for all certificates of qualification and contractors licensing. Council member Paul Danaher, asked what is the difference between certificates of supervisor registration category and certificate of qualifications category? Melissa Brill, Supervisor of Licensing Branch, said the certificates of supervisor registration is basically the same as certificate of qualifications. The only difference is the name which is based on old state codes that are outdated and no longer enforced. Melissa also said they are proposing to call the supervisor certifications, certificate of qualifications. Council member Jim Rowland, stated was there any consideration of how it would affect small contractors? Barry Archer, stated the annual fee will go down $12.00 which lessns the hassle because you would go to the city once every three years rather than once every two years to renewal your license or registration. So it really helps a small contractor and save money. Jim Rowland, said what about the process of getting certified. Melissa Brill, said getting certified will not change. The only difference is the annual cycle would be longer.

Steve Worley, ( Streets & Traffic Division), Public Works Department, stated this ordinance is a routine traffic regulation that has been initiated by public works for ninety days. Regulations has undergone publication test and evaluation which consist of various removal and installation of traffic control devises and signs. Mr. Worley request passage of this ordinance.

Authorizing a $986,668.41 First Amendment to Agreement No. 990049 with Bucher, Willis & Ratliff Corporation for engineering services in connection with the North Brighton Road improvements.

Stan Harris, Public Works Department, stated this ordinance would authorize a design contract with Bucher Willis & Ratliff Corporation. The purpose for this contract is to widen the existing roadway from a two-line roadway to a five line roadway which is two lines in both directions and a sixteen (16) foot grass median on North Brighton Road between Vivian Road to Pleasant Valley Road. The estimated cost is approximately $13 Million dollars and we are estimating completion of this project in February 2005. All funding for this project is coming from the Capitol Improvement Program.

Tom Bean, Public Works Department, stated this ordinance would authorize a contract with Jenkins & Associates, Inc., to restore, rebuild and recreate the lobby area at the lower level of the municipal auditorium. Council member Terry Riley, asked when do you anticipate completion of the project? Mr. Bean, said they anticipate the completion after the two Basketball Tournaments that will be in the auditorium this Spring during the month of March.

Authorizing expenditure of $400,000.00 in additional funds to complete Contract No. 654 Brookside Drainage Area and Sanitary Sewer Study; and authorizing expenditure of funding therefor.

Jim Mellen, Water Services Department, stated this ordinance would authorize additional funding to design the Hunting Release Sewage. Previous studies that were conducted in that area found various manhole problems in connection between sewers and storm sewers. Council authorize previous work to correct the problem and the work is ongoing. This design would provide a release sewer that would increase the amount of flow that could be carried in this area and reduce flooding in the neighboring homes.

Authorizing an amendment to the agreement with Kansas City Terminal Railway relating to repairs and replacement of the St. Louis Viaduct over Terminal Railway tracks.


OPERATIONS COMMITTEE recommends "ADVANCE AND DO PASS"
Stan Harris, Public Works Department, stated this ordinance would authorize an agreement with Kansas City Terminal Railroad Company. The purpose for this agreement is to share the cost of replacing the St. Louis Viaduct in the central business district. Mr. Harris said the cost of the bridge is estimated at $4.6 million dollars. Our cost share agreement states the Kansas City Terminal and the City of Kansas City, Missouri will split the non-federal share on the bridge up to an maxim of $1.4 million dollars each. The total project cost is estimated at $4.6 million dollars and our federal grant is approximately $2 million dollars which leaves $1.3 million dollars for each Kansas City and Kansas City Terminal. Mr. Danaher, asked who is responsible for the amount above the $1.4 million? Stan Harris, answered, then we would have to sit back down and talk to them again, because we are working with a budget.

Amending Chapter 2 of the Code of Ordinances by repealing Section 2-1401 and enacting in its place a new section, reducing the number of divisions of the municipal court.

Council member Paul Danaher, stated he introduced this ordinance last week that we have more than enough Municipal judges to handle the case load at the Municipal Court. Bernard Shneider, stated there are approximately 1,260 cases on today's docket in terms of serving the public. People do not like waiting in lines and it is hard to get in on the telephones. Mr. Danaher asked, do we have any judges that work the telephones? Mr. Shneider, said no, it is just a matter of service whether or not if we want to process people quickly and get things done in a fast and friendly manner.
