Authorizing the Director of Convention and Entertainment Facilities to extend the three (3) year marketing agreement amendment with the National Association of Intercollegiate Athletics, for one (1) additional year; and appropriating $50,000.00 in the Convention and Tourism Fund.


FINANCE, GOVERNANCE & ETHICS COMMITTEE recommends "ADVANCE AND DO PASS, DEBATE"
Oscar McGaskey, Director of the Convention & Entertainment Facilities, stated that this ordinance was extending the contract agreement with the NAIA for an additional year. The agreement adds additional events to be hosted by the City of Kansas City through the year 2014. It was also stated that the supplementing of the event by the City could cease at anytime in the future. This was agreed upon by the representatives of the NAIA.

Approving and authorizing settlement of several lawsuits entitled Citadel Plaza, LLC v. City of Kansas City, Missouri, et al., Jackson County Circuit Court Case No. 1016-CV03781, First Security Bank & Trust Co. v. Community Development Corporation of Kansas City, et al., Jackson County Circuit Court Case No. 1016-CV04926, and Weiskirch and Parks Engineers, Inc. v. Community Development Corporation of Kansas City, et al., Jackson County Circuit Court Case No. 1016-CV07486; estimating $15,000,000.00 of bond proceeds; appropriating $15,000,000.00 to the 2012 Southtown Urban Life Development Bond Fund; and recognizing an emergency.


FINANCE, GOVERNANCE & ETHICS COMMITTEE recommends "ADVANCE AND DO PASS AS A COMMITTEE SUBSTITUTE, DEBATE"
Galen Beaufort, City Attorney, stated that this ordinance would authorize the issuance of bonds to settle a lawsuit regarding the Citadel area (Southtown Urban Life Development). By settling the lawsuits, the City would own over 70% of the property in the development area and would be free to develop the area. The specifics of this ordinance was discussed in closed session.

 The following ARTS Reports will be presented: 1. Tax Increment Financing Follow-Up 2. Estimating Tax Dollars Owed to TIFC City Auditor Gary White, presented background information on these two items. Dan Bagunu, Finance Department, presented the responses to the recommendations. A copy of the recommendations and responses are on file in the Office of the City Clerk. The Comprehensive Annual Financial Report (CAFR) and Popular Annual Financial Report (PAFR) for the fiscal year ended April 30, 2011 will be presented. Because of time restraints, Eric Clevenger and Gary Morris gave an abbreviated version of the CAFR Report to the committee. Mr. Clevenger suggested that the committee look over the report and direct any questions they may have regarding the report to either Gary Morris or him directly. Gary Morris stated that the information supplied in the quarterly financial statements are in direct correlation to the information supplied in the CAFR report. There may be general discussion(s) on current Finance, Governance & Ethics Committee issues. Pursuant to the following subsections in 610.021 of the Revised Statues of Missouri, there may be a closed session to discuss: Legal matters, litigation or privileged communication with attorneys, pursuant to subsection 1; Real Estate, pursuant to subsection 2; Personnel, pursuant to subsection 3 & 13; Sealed bids or proposals, pursuant to subsection 12; Negotiations with employee groups, pursuant to subsection 9. The committee voted 5-0 to go into closed session to discuss litigation. The City Clerk's Office now has equipment for the hearing impaired for use with every meeting. To check out the equipment please see the secretary for each committee. Be prepared to leave your Driver's License or State issued Identification Card with the secretary and she will give you the equipment. Upon returning the equipment your license will be returned.
