Authorizing the Director of Convention and Entertainment Centers to execute a Preferred Audiovisual Provider Agreement with Swank Audio Visuals, L.L.C. to provide audiovisual services at the Kansas City Convention Center; estimating revenue in the amount of $130,000.00 in the Convention and Tourism Fund; and appropriating it to the Convention Center Facility Maintenance account of the convention and Tourism Fund.

Ocsar McGaskey, Conventions, explained that the ordinance was for an agreement with Swank Audio Visuals, L.L.C. for the maintainance, repair and improvement of the Kansas City Convention Center.

Authorizing a $2,000,000.00 agreement with the Jackson County Sports Complex Authority from the Convention and Tourism Fund to be used in connection with the Harry S. Truman Sports Complex.

Dr. Eddy explained that is ordinance was a housekeeping measure that allowed for capital maintenance, repairs and improvement to the Harry S. Truman Sports Complex.

Calling for submission to the voters of Kansas City, at a special election to be held on November 8, 2005, a question amending the Charter of Kansas City by repealing its current twenty articles and enacting thirteen new articles to be known as the Charter of the City of Kansas City, to reflect the home rule authority granted by the Missouri Constitution; to adopt the Missouri general municipal election day, to require elected officials be residents of the City immediately prior to their election; authorize the delegation of duties among City departments; to authorize the establishment of new park districts; to re-establish the Internal Auditor as an appointee of the City Manager; to accelerate the adoption of ordinances by requiring two rather than three readings; to require the establishment of debt and economic incentive policies; require decennial review of the Charter; to authorize the Council to impose payments in lieu of taxes on enterprise departments of the City not to exceed 10% of the department’s gross revenues; and provide for other municipal purposes; fixing the dates when the amendments shall take effect; directing the City Clerk to notify the responsible election authorities of the election; and recognizing this ordinance to be an emergency measure.

Bill Geary, Assistant City Attorney, stated this would be the first of possibly there hearings regarding the matter of Charter changes and issue to be placed on special election ballots. The was discussion regarding three amendments: The nature of the City Auditors appointment, requiring the City Manager to attend meetings and requiring Council to draft debt policy. Additionally, Councilman Skaggs open discuss regarding section 906a which he believed would limit or reduce Council power as it relates to the setting of salaries. There was no discussion of retirement age for judges and Councilman Eddy inquired about section 204d relating to the requirement of residence for candidates for Council and Mayor. The item was held to allow further discussion and public input.

Authorizing a $100,000.00 amendment to a contract with Kutak Rock LLP for legal services related to City of Kansas City, Missouri v. Housing and Economic Development Financial Corporation (No. 05-00368-CV-W-GAF).


FINANCE COMMITTEE recommends "ADVANCE AND DO PASS, DEBATE"
Galen Beaufort, City Attorney, stated that this ordinance was to amend a contract with Kutak Rock LLP for legal services. Representatives for Kutak Rock, LLP were present to answer questions and explain their roll in the litigation with HEDFC. Mr. Beaufort assured the Committee that there was progress being made and that the bulk of the remaining legal services would be handled by the cities own legal team. The committee asked and received an itemized listed of legal service provided and the rate. Councilman Skaggs asked if the representative were being paid by the city for appearing be for the committee. Brad Baumgard, Kutak Rock LLP, stated that yes the three members of the team that were present were paid by the city to attend the committee meeting. City Manager, Wayne Cauthen, added that he supported that use of Kutak Rock LLP's legal services. He said that this situation was of a nature that required more staff and expertise in a short span of time than staff could provide for this matter. He restated that now that the bulk of the matter had been hashed out, city legal staff could take over and bring the matter to a positive conclusion.
