Vince Hustead, City Planning, explained that the ordinance would approve a preliminary plat for the Hunt Midwest Business Park. David Matthews of John Lutgen and Associates represents the developer. Vince Hustead stated there were no known issues or opponants to the project at this time and everything seem to be in order and on schedule.

PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
John Eckhardt, City Development, stated that 040678 and 040679 are related case. The first deals with the a change to the land use plan. The developments original plan called for a GP3 and the developer would like to change it to GP4. The plan consist of four phases the first of which would include 280+ units in a multi-family complex. The second would be 70 townhomes, The third phase would include 4-4 plexes and the fourth and final phase would be for single family homes. Councilman Fairfield asked if there would be a barrier between The Autumn Ridge Apartments and this new development. Shawn Cunningham, Developer, stated that he was currently in negotiations with another developer in the area, the resident association, City Staff and other concerned parties to determine the best course of action for the completion of an access road and the buffer between the apartments and the new project. He said that at this point they were leaning toward a landscaping buffer rather than fencing and the to developers were closing in on an agreement regarding the access road. The other developer has began construction for his project and would need the same access so it is likely that he will begin the road also. He estimated the cost per single family homes in the area and within the project would range between 120K to 130K. The average size would be 1600-1800 square feet.

PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Jennifer Thomas, City Planning, described the ordinance as a condominium conversion. The buildings near 48th & Jefferson would not change the exterior but would convert the interior into for sale condo units. A waiver for both the set back and the parking have already been approved. Due to the buildings former use. The set back and parking requirements were different. The waiver will allow the project to go forward with out the added expense of restricting the exterior to me those requirements. Condominiums are typically designed for those who desire a low maintenance lifestyle where shopping and entertainment within walking distance so parking may not be as high a priority for them. She believes that is why the waivers were granted. Joy Hayes, Polsineilli, represents the developer and was unsure of the cost per unit but agreed to provide that information to the committee at a later date. Councilman Nash said that it seemed that a lot of condo construction and reconstruction was taking place in the city. He hoped that the market could bear it. Joy Hayes requested advancement.

Jennifer Thomas, City Planning, stated that this ordinance was for another condominium conversion. The location of the project is near 50th & Wyandotte it is and will continue to be known as the Peanut. Waivers for the set-back and parking have been approved for this project as well. However there is an issue regarding the language in the ordinance that requires the developer to construct or reconstruct sidewalks, curbing etc. Patricia Jensen, White, Goss, stated that her client Dan Hurst the Developer would like to have that language changed to reflect his agreement to repair and maintain sidewalks within a range of the of his property. He believes that as it is now written he could be responsible for replacement of sidewalks not just repair and maintain of walkways butting his property which would be reasonable and acceptable to the developer.

Reestimating and appropriating revenue in the amount of $4,200.00 to the Property and Relocation Services account of the General Fund and authorizing execution of a Relocation Services Agreement with the Community Development Corporation of Kansas City, for relocation services provided for the Mooney Villa Project by the City.

Edgar Jordan, City Development, explained that the ordinance would allow $4200.00 in relocation allocation for parties needing assistance moving from the Mooney's Villa Project. The City will be reimburse by the Community Development Corporation of Kansas City.

Reestimating and appropriating revenue in the amount of $21,000.00 to the Property and Relocation Services account of the General Fund and authorizing execution of a Relocation Services Agreement with the Kansas City Neighborhood Alliance, for relocation services provided for the Oak Point Project by the City.

Edgar Jordan, City Development,testified regarding a relocation service agreement with The Kansas City Neighborhood Alliance for relocation services for the Oak Point Project. The amount of the allocation funds is $21,000.

Accepting the recommendations of the Tax Increment Financing Commission as to the First Amendment to the 1200 Main/South Loop Tax Increment Financing Plan; approving the 1200 Main/South Loop Tax Increment Financing Plan; and designating a Redevelopment Area.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Missy Wilson, explained the ordinance affected the 1200 Main project amending the projected construction cost and the subsequent reimbursement to the developer. The projected cost was 44 Million and the actual cost is 45 Million. Councilman Nash asked why there was such a large increase in cost. Missy Wilson responded that all the cost of construction labor, material and shipping had all increase for a number of reasons but primarily because there had be an increase in demand for material and there for the distrubutors of those goods and services had pass the cost on to developer. Councilwoman McFadden-Weaver asked were the goals for WB/WBE and minority involvement being met on this project. Missy Wilson stated that a goals were met for both construction and professional involvement. Councilwoman Cooper voiced an concern that the cost of the project might soon override the benefit of the project. She added that she thought there was a low APR if the project didn't generate big revenue. Ron Drury the developer asked for advancement.

Missy Wilson, TIF,testified regarding the 5th amendment to the 909 Walnut and the 927 Walnut project H. She said that she was before the Committee again to make them aware of the increase in reinbursement to the developer the cost projected was estimated at 53 Million and had increased to 67 Million. The prior reasons for the increase are increase in APR, increase in material and an increase in the cost of shipping. The project had been amended to included a roof top garden and additional sidewalks which also greatly increase the cost for the project.

Larry Stice, City Planning, explained that the ordinance related to a vacation of the streets within the Blue Parkway Town Center 2nd Plat. The affected portion involved the proposed grocery store. There are still some issues with the private utility easements within the project. City staff recommends approval because they believe that a acceptable agreement is currently being worked out with the utility. Mark Bryant, Polsinelli, requested advancement.

Virginia Walsh, City Planning, explained that there had been some question whether the developer had built more than the original plan recommended. However after some research it was discovered that the developer had built less than the original plan called for and was now with in the scope to added or meet the original agreed upon square footage. She added that there had been an on site visit to determine the correct footage. City staff recommends approval.

RESOLUTION - Approving an amendment to the Sports Complex Area Plan, being that part of Kansas City bounded by 23rd Street on the north, Chrysler Avenue on the east, 67th Street on the south, and the Big Blue River on the west, by modifying the Land Use Plan and Map for an area of approximately 2.6 acres generally located on the north side of 23rd Street Trafficway, east and south of Television Place (Blue Summit Drive) (specifically located at 8500 and 8600 E. 23rd Street, 8622 E. 23rd Street Trafficway and 8612 Stark Avenue) to recommend industrial uses instead of residential uses. PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "IMMEDIATE ADOPTION"
John Eckhardt, City Development, stated that 040663 and 040664 were companion ordinances. The first a resolution amends the plan that originally was for residential construction. The second is an ordinance requesting an change in the zoning from M2A. He added that since the 1950's the area had been used for industrial purposes. Because of the secluded rough terrain in the area it would be hard and very costly to make it fit for any other use. However staff and some residents have concerns on the "open zoning" because that zoning would allow some undesirable uses such as animal burial, asphalt mixing and chemical processing. Councilman Fairfield believes there is and easy solution to address the concerns of staff and resident and that would be to add a clause in the ordinance limiting the industrial uses. Jim Bower, White Goss, express his concerns that if the Committee determined that an area plan needed to be in place for the project it would cause undue cost and inconvience to his client. He shared several graphic showing seclusion of the area and its continued use as industrial over several decades. Councilman Fairfield asked staff and Mr. Bowers would it be acceptable to add the clause and allow the project to go forward. Wayne Cranes Owner of the property and business in question stated that he lived near the property and had no intention to use the property for anything other than storage and light industrial uses which it had always been used for he simply would like to expand what is already there. Paul Levota, Owner of Appraisal Group, a business in the area supports the resolution. Kurt Doraty, State representative, supports the resolution. Councilwoman Cooper acknowledged the state representative and stated that she to supports the resolution and ordinance.
