Authorizing the City Manager to enter into a funding agreement with the Planned Industrial Expansion Authority of Kansas City, Missouri for blight remediation in the Armour Gillham PIEA Planning Area in the amount of $2,500,000.00.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS, DEBATE"
Thiis Ordinance will authorize the City Manager to execute the funding agreement with the PIEA. The agreement would provide for a total financial obligation not to exceed $2.5 million, net present value using a four percent douscount rate. The funds would be payable in annual installments of up to $200K commencing in 2014 until 2023 with a final payment to the PIEA in 2023 in the amount necessary to equal the total CIty contribution as appropriate by the CIty Council. The City's first payment will be made after the PIEA submits evidence that it has excuted a Redevelopment Contract with the Apartments of Newbern, LLC, the redeveloper of the Newbern project. The Newbern project includes the redevelopment of an existing multi-family apartment building at 525 East Armour Boulevard.

Amending Chapter 74, the Kansas City Redevelopment Ordinance, by adding a new Article V, Reclamation of Blighted, Substandard or Insanitary Areas, to guide City processes in the reclamation of blighted, substandard or insanitary areas and the condemnation of blighted properties taken under the authority of Section 21, Article VI, of the Missouri Constitution.

Ted Anderson, City Attorney's Office, gave the staff report on the Ordinance. This new article in Chapter 74, the Kansas City Redevelopment Ordinance, spells out the City’s constitutional authority, and its authority under the Missouri Statutes to reclaim blighted properties by condemnation, negotiation and purchase, or by donation. It also lays out the purposes for such actions.

Approving the First Amended and Restated 18th and McGee PIEA General Development Plan on about 2.9 acres generally bounded by 17th Street on the north, 18th Street on the south, McGee Street on the west and Oak Street on the east with a small portion extending east of Oak Street; and declaring that area a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Missouri Planned Industrial Expansion Authority (PIEA) Law 100.300-100.620. Staff supports the amended PIEA plan as a means of facilitating the renovation of the existing structures and parking area. Staff recommends a number of revisions to the text of the plan. The plan should clarify that the uses eligible for incentives are tied to DC zoning as well as the DC recommendation of the area plan. Further, staff recommends that certain uses allowed by DC zoning not be eligible for incentives. Those include adult businesses, drive-through facilities, gasoline and fuel sales, blood/plasma centers, non-accessory parking, and vehicle sales and service uses. Note that the current zoning of the property is M1-5, a light industrial classification that allows DC uses and more. The UR rezoning approval process allows review of a number of site design issues that would not necessarily be triggered solely by a building permit. Staff recommends that certain site improvements be made even if the UR rezoning is not required, due to a waiver or use of Department of Interior standards. These include repair or new construction of sidewalks along all street frontages, installation of streetscape per City standards and provision of perimeter and interior landscaping in the parking lot per 88-425. Staff also recommends that money in lieu of parkland fees be paid for the new residential units. This is typically done with the platting process, but if platting is not required staff recommends the payment be tied to the issuance of a building permit. discussed the findings of blight.
