Peter Schlesinger, City Planning, explained that the ordinance allows a preliminary plat of 37.69 acres of land generally located near Woodland Avenue between Blue Ridge Blvd. and East 129th Street. Trent Robinett and TREKK Design Group, LLC, represents that applicant Stephen Johnson. The proposed site is currently undeveloped with the surrounding area being used as single family residential and church. The has been designated to be low density residential uses. The developer intends to develop the subdivision in one phase. Some concern had been expressed to staff in writing and by phone from property owners in the area regarding the increase of lot sizes and the reduction of entrances to the subdivision. The City Plan Commission made 22 recommendations. The Committee recommended the item be held until June 2, 2004.

Englewood Road and Missouri Highway 169and enacting in lieu thereof a new ordinance of like subject matter that corrects Condition No. 7 to require 75 feet of right of way dedication rather than 150 feet. This ordinance is a legislative procedure required by the City Charter after the plat has been approved by the city Plan Commission and the grades and closure have been checked and approved by the Engineering Division of Public Works Department. The property is located in the Center School District and there are no known opponents. Staff recommends approval and request advancement.

A fiscal note is attached to the original on file in the City Clerk's Office.
