Patricia Jensen, Assistant City Attorney, stated the communication is related to resolution 990751. Fred Earnst, McDowell, Rice, Smith & Gaar. Mr. Earnst stated the communication is to acquire the facility located at 10500 W. 52nd Street, This will be a multi family housing revenue bond. Because of state law requirement it is required that consent from the municipality in which the project is located. Committee recommended approval of the ordinance.

Don Gustafson, City Development stated the ordinance is a request for a plan amendment located at 79th & Wornall. The applicant is proposing a retail commercial building. Approval of the ordinance is to change the proposed fast food to a retail store and tire store. The developer is required to improved and widen Wornall Road. Councilman Rowland expressed concerns regarding a traffic sturdy. Committee recommend to hold the ordinance for one week to allow the applicant to meet with Councilman Rowland to address his concerns regarding the project.

Approving an amendment to a previously approved development plan in District PD/RA (Agricultural/Planned District) on approximately a 42 acre tract of land generally located on the east side of N.W. Waukomis Drive, approximately one-quarter mile south of N.W. 64th Street, for the purpose of deleting an approximately 11.58 acre tract of land from said development plan. (11777-PD-4)

Ordinance 990618, 990619 and 990620 are companion cases. Committee substitutes were submitted on the ordinances. Virginia Walsh, City Development gave an overview of the ordnance. The ordinances involves a total property area of approximately 40 acres. The purpose of ordinance 990618 is to amend the forty acre site to delete 111/2 acres. Ordinance 990619 will rezone 111/2 acres from PD/RA to district R-1 to allow for future single family development. Ordinance 990620 will approve the preliminary plat of the project. Sam Aylette, Aylette Survey testified on behalf of the ordinance and concurs with staff's report. Committee recommended approval of the ordinance.

He explained to the committee the significance of the ordinances and which projects they are ready to proceed with. A committee substitute was submitted on ordinance 990702. Ordinances 990702, 990703, 990705, 990706 and 990711 were approved by committee. It was the consensus of the committee to hold the other ordinances off the agenda until the projects are ready to come forth.

Ordinances 990579, 990580 and 990581 are companion cases. John Eckardt, City Development stated that the project will remove 15.4 acres of land from the Executive Hill North plan and approve a new GP Development plan. The applicant has submitted a new case requesting a residential land use in conformance the amended plan. "The Vintage" is located about 3/4 mile east of I-29 on Tiffany Springs Parkway, The 25 acre project is bounded by Tiffany Springs Parkway on the south and a parking lot on the west. The Vintage is proposed to contract 336 multi family units on 25 acres creating a density of about 13.44 acres. There will be 14 apartment building, 16 garage building , two clubhouses, two pools and a maintenance building. City Plan Commission and City Development staff recommend approval with certain conditions. Councilwoman Cooper, expressed concerns regarding street lights. Committee concurs with staff's recommendation and recommends approval.
