Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0300, rezoning an area of approximately 5.8 acres generally bounded by a line located about 400 feet north of N.W./N.E. Harlem Road on the north, N. Walnut Street on the east, N.W./N.E. Harlem Road on the south and N. Baltimore and the alley next west of N. Baltimore on the west from Districts R-2b (Two-Family Dwellings) and C-2 (Local Retail Business) to District M-2a-p (Heavy Industry - Limited District), and approving a preliminary plan for the same.

Don Gustafson, City Development Department, stated that the preliminary plat will create 23 commercial condominiums. The project location is the 5700 block of N. Broadway north of NE Englewood Rd. Committee recommended approval.

Tim Parks, City Development Department stated that the site is located in the 3700 block of Highland on the west side of the street. The preliminary plat calls for two residential lots. The lots are currently being developed by Habitat for Humanity. The developer is required to formally plat the land in order to create the two lots because the proposed lots do not meet the subdivision Regulations for the lot split. Committee recommended approval of the ordinance.

Approving an amendment to a previously approved preliminary plan in District CP-1 (Neighborhood Planned Business Center) on approximately a 1.66 acre tract of land generally located at 4311 N.E. Vivion Road. (5200-CP-9)

Patty Noll, City Planning & Development, stated the ordinance will amend a previously approved development plan to allow construction of a building addition for retail space located at 4311 NE Vivion Road. Within the CP District two office buildings and one retail building have been constructed. A vacant single family home remains within the western portion of the project. James Brown, Architects and Associates, applicant, concurs with staff's recommendations.

Repealing Ordinance No. 000982; approving the plat of Chouteau Crossings, an addition in Kansas City, Clay County, Missouri; accepting various easements; establishing grades on public ways; authorizing the Director of Public Works to execute certain agreements; and authorizing the City Clerk to file this ordinance and attached agreements.

Accepting a $500,000.00 Brownfields Cleanup Revolving Loan Fund Grant from the U.S. Environmental Protection Agency; authorizing the Director of Housing and Community Development to enter into an agreement with the EPA regarding grant administration; estimating revenue and appropriating $500,000.00 to reflect the funding; authorizing an agreement with EDC Loan Corporation to administer the loan program; and directing the Clerk to record the agreement.

Andrew Bracker, Brownfields Coordinator, stated that the ordinance will accept $500,000 from the U.S. Environmental Protection Agency to finance the cleanup of brownfield sites in Kansas City.

Approving and designating Redevelopment Project Area 1 of the Chouteau I-35 Tax Increment Financing Plan as a Redevelopment Project and adopting tax increment financing therein.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Dave Fenley, Attorney, Tax Increment Financing Commission (TIF) state that project 1 is one of three projects comprising the Chouteau I-35 TIF plan. The project provides for the disposition into the Chouteau I-35 TIF Special Allocation fund. The redevelopment calls for construction of a 244,709 square foot retail shopping center with full service supermarket, a large box retailer, two smaller in-line stores and t three retail pad sites. The total cost associated with the redevelopment of projects 1 & 2 is approximately 21.4 million dollars. Committee recommended approval.

RESOLUTION - Approving an amendment to the Westport Planning Area Plan, being that part of Kansas City bounded by the 31st Street Trafficway, State Line Road, Ward Parkway and Troost Avenue, by modifying the Land Use Plan and Map for an area of approximately 7.7 acres generally bounded by Westport Avenue and Archibald Street on the north, 43rd Street on the south, Bridger Road on the east and Roanoke Road on the west to recommend "multi-family residential uses - high density" instead of "multi-family residential - low density uses" and "retail uses".


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "IMMEDIATE ADOPTION"
Resolution 001069, Ordinances 001070 and 001071 are related cases. Larry Stice, City Development Department, updated the committee regarding the status of the project and what changes were implemented. He stated there was a difference of opinion regarding the rezoning on the public/private nature of the street and also the design of the buildings. Councilwoman Cooper expressed her appreciation to the parties involved in working together to come to an agreement. She stated that the plan will be a great improvement in the Westport Area. Aaron March, Attorney, White, Goss, Bowers, March & Shulte, concurs with staff's recommendation. Area residents spoke in support of the project.

Declaring the area generally bounded by Westport Avenue and Archibald Street on the north, 43rd Street on the south, Bridger Road on the east and Roanoke Road on the west, to be a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Missouri Land Clearance for Redevelopment Authority law and approving the Urban Renewal Plan for the same, said plan to be known as the Westport Housing Urban Renewal Plan.
