Amending Article XI of the Administrative Code of Kansas City entitled "Finances" by enacting a revised Section A11.25 entitled "Debarment of Bidders for Public Works Contracts" to modify the make up of the hearing panel.


AUDIT AND OPERATIONS COMMITTEE recommends "DO PASS AS A COMMITTEE SUBSTITUTE"
Diane Doran, Asssistant City Manager, stated this ordinance will amend the Administrative Code, Section A11.25 entitled "Debarment of Bidders" for Public Works contracts by changing the make up of the hearing pannel from the department head initiating the proceeding, the contractor's designee and a third party. The third party will be agreed upon by the department head and the contractor. Under the ordinance the panel would consist of the City Manager, or his designee, the department head and the contractor. Mrs. Doran stated this is a house cleaning provision. When the current ordinance was adopted, the fourth person on that body was added. As time went on the City became concerned that a fourth person, the person who is the sub- ject of the debarment proceedings, and the City Manager's Office having to agree was not practical. This ordinance eleminates the fourth person and allows the City Manager's Office designee and the department head to be voting members, along with the contractor having the proceeding brought against him to also be a voting member. Councilman Palermo stated he had introduced a substi- tute ordinance because he felt this one presents a conflict. He felt the conflict arose when the person charged was a member of the panel. Mrs. Doren stated that this gives the person charged the assurance that they have been heard. Councilman Palermo pointed out that the criminal justice and judicial system is based upon a person having their day in Court, but they do not participate in the decision of whether or not they are guilty. He recommended adoption of the substitute ordinance. Jim Scott, Prevailing Wage Monitor for the City, stated he had just seen the substitute. From the conversations he had with persons in the past few days, he is in full agreement that the substitute ordinance should be adopted.

Authorizing a contract in the amount of $116,622.75 with Capital Electric Construction Co. for upgrading the traffic signals at Grand Avenue and Independence Avenue and Grand Avenue and 6th Street.


AUDIT AND OPERATIONS COMMITTEE recommends "DO PASS"
Larry Frevert, Director of Streets - Public Works Department, stated this ordinance is for the upgrading of traffic signals Grand Avenue and Independence Avenue and Grand Avenue and 6th Street. This $116,622.75 improvement will provide new mast arm indications, a new state of the art controller and larger signal bases. The improvement will improve traffic safety, as well as the aesthetic enhancement.

To establish the grade on Northeast 42nd Street from a point 150.0 feet east of the centerline of North Holmes to a point 275.0 feet west of the centerline of North Holmes and change and re-establish the grade on North Holmes from Northeast 41st Terrace (west) to Northeast 42nd Terrace (west) and change and re-establish the grades on Northeast Parvin Road from the centerline of North Holmes to a point 195 feet east of the east line of North Holmes (south) in Kansas City, Clay County, Missouri.

Gurnie Gunter, City Engineer and Public Works Depart- ment, stated the resolution establishing the grade was passed on 6-16-90, declaring it necessary to change and reestablish the grades. No adverse comment was received.

To change and re-establish the grade on North White Avenue from N.E. 49th Street to N.E. 50th Street in Kansas City, Clay County, Missouri.


AUDIT AND OPERATIONS COMMITTEE recommends "DO PASS"
Mr. Gunter stated this ordinance is to change and re-establish the grade on North White Avenue from N.E. 49th Street to North 50th Street. When the original grades were established, the streets were never fully improved. The developer is now ready to re-establish and change these grades. There was no adverse public comment on this ordinance.

Authorizing the Director of Water and Pollution Control to execute a Quitclaim Deed and Subordination Agreement with the United States of America releasing the right-of-way for certain water mains that existed prior to the construction of Longview Lake.


AUDIT AND OPERATIONS COMMITTEE recommends "DO PASS"
Roy Jackson, Director of Water and Pollution Control, stated when Longview Lake was being constructed the City introduced an agreement with the Corps of Engineers to move necessary water lines out of the way of the lake. They have received easements that the lines are laid in. This ordinance releases easements no longer needed.
