PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "HOLD ON AGENDA"
Don Gustafson, City Development gave an overview of the ordinance. The purpose of the ordinance is to allow 50 family lots. The site is located on the west side of N. Bennington. The applicant is requesting approval of a new preliminary plan to replace a previous one. The project will be completed in two phases. There were some concern from neighbors regarding traffic issues. City Plan Commission recommended approval subject to 14 conditions. The applicant has been negotiating with Public Works Department regarding improvements on Bennington. Mike Burke, Attorney, representing the applicant, spoke in support of the ordinance. He stated that he has been to the committee before almost with the same identical plan. Public Works desired instead of doing half street improvements that the developer do a full street improvement on Bennington which required additional easements but he was unable to obtain the easement from one of the neighbors. Therefore, the plan has been reconfigured. Keith Nelson, 4543 N. Bennington, spoke in opposition expressing concerns about density and street improvements and widening. He asked that the project be delayed until something is done with the street. Shirley Smith, resident, stated that the road is so hilly the road needs to be improved from Parvin Road to 48th Street. Councilwoman Williams-Neal asked staff to respond to the resident's issues. Dion Waldon, Public Works stated that when developments are looked at certain improvements that are necessary for the development to be safe are required. Moshin Zaidi, Public Works Department/Traffic Division, stated he did not think the development would cause any traffic problems. Committee recommended to hold ordinance on the agenda for one week to allow the easement issue to be worked out.

The purpose of the plan amendment is to permit a auto service center. She also gave a thorough explanation of the project. City Plan Commission recommended approval subject to certain conditions. Jim Kratz, John Luitjen & Associates, spoke in support of the project. Committee recommended approval.

RESOLUTION - Amending the South Central Area Plan by amending the Proposed Land Use Plan and Map in an area generally bounded by Woodland Avenue on the east, 54th Street on the south, Highland Avenue on the west and 53rd Street on the north by changing the recommended land uses from "public/semi public uses" to "low-density residential uses".

Ordinance 990135 and Resolution 990137 are companion cases. Eric Jensen, City Development stated the ordinance is a request to consider approval of an amendment to the south central area plan, land use map to change the recommended land use from public/semi public used to low density residential uses. Ordinance 990135 is a request to consider approval of the "Little Sister's of the Poor" Urban Renewal Plan. The site is located at 53rd & Highland. There are several structures currently on site. The site is currently vacant, it was closed in 1982 which has suffered from vandalism. The facility was sited by the City for dangerous building. Demolition was ordered in April '94. To this date no demolition has occurred. A planning and design process was initiated by Housing and Community Development. The urban renewal plan will provide the developer with assistance for tax abatement in which improvements will not be assessed for a period of ten years. The plan does allow for eminent domain. Linda Spence, 1512 Bushman Drive, President of Blue Hills Neighborhood Association, stated that the neighborhood is excited about the possibilities of adding new housing to the area and the renovation of the smaller building on the project location. Area residents spoke in support of the plan. Stuart Bullington, Housing and Community Services stated that the abatement and demolition process is proceeding. He is working with the National Advisor of Council of litigation in which the process should be completed next month. Committee recommended that resolution 990137 be adopted and ordinance 990135 be approved.

Ordinances 990140 and 990141 are companion cases. Patty Noll, City Development stated that the ordinances involve an amendment to the Line Creek Valley Area Land Use Plan also approving a Community Unit Project plan. The site is located at NW 68th Street & N. Edison. Northwest 68th Street is currently being improved by the city. The CUP plan proposes development of 27 duplexs lots to allow construction of 54 duplex units in district R1a. City Plan Commission recommended approval of the projects. The project is to be completed in two phases. Mike Flowers, Aylette Survey Co., 201 NW 72nd Street Gladstone, Missouri, concurs with staff's recommendation in reference to resolution 990140. He stated that originally the plan was submitted as one phase but since City Plan Commission met the plan has been revised for the project to be completed in two phases. Committee recommended approval of the ordinances.

Don Gustafson, City Development testified on behalf of the ordinance. He stated the proposed rezoning is for 555 acre site located on 108th Street, south side of I-435 & 96th Street. Ordinance 990158 will rezone from R1aa to R1a. R1aa requires a minimum of 1500 square foot per lot, R1a allows 7500 square foot per lot. There are a number of condition outlined within the ordinances Mike Burke, Attorney, 2345 Grand stated he has worked closely with city staff to improve the project. There were certain conditions Mr. Burke expressed concerns about; 1) parkland dedication is a requirement that can be met by the developer at the option of the developer with payment in lieu of private open space; 2) street improvements; Staff has requested that the developer contribute $125,000.00 towards funding for a traffic signal developers wants to donate 1/2 of the cost for the traffic signal. Committee recommended to hold resolution 990157 and ordinances 990158, 990159, 990160, 990161, 990162 and 990163 on the agenda until March 17, 1999.
