Virginia Walsh, City Development testified on the ordinance. The purpose of the ordinance is to rezone a 30 acre tract of land to construct a church building located at N. Cookingham and N. Robinhood. City Plan Commission recommended approval with certain conditions. Mike Flowers of Aylett Survey concurs with staff recommendations and asked that the ordinance be advance.

Lee Dixson, Public Works Department, stated the plat is for a four lots residential development, located at 43rd & Paseo. The developer was required to submit a storm drainage study for silt and erosion control and extend sewers. All of the grades and closures have been checked and recommended approval of the ordinance. Ron Gover, 9920 Frost Creek Dr. Othwa Tennessee stated plan to proceed with development with approval of the plat.

Lee Dixson, Public Works Department stated all of the grades and closures have been checked and recommended approval of the ordinance. Councilwoman Cooper expressed concerns regarding the water drainage study. Mr. Dixson, stated that it is not required at this time, once development begins the storm drainage study will be necessary. Committee recommended approval of the ordinance.

Larry Stice, City Development stated that approval of the ordinance will vacate the north/south and east/west alleys, north of 5th Street and west of Wyandotte. The purpose of the vacation is to allow development of the Jax Loft Apartments and Conover Place Apartments. The vacated right of way will be used as a courtyard area and tenant parking. City Plan Commission recommended approval subject to retention of the utility easements.

Patty Noll, City Development stated that ordinances 981148 and 981149 repealed previously passed ordinances 970035 and 981144 and 990644. The ordinances pertain to 2.67 acres bounded by 48th Street on the north, Roanoke Parkway on the east, Ward Parkway on the south and Belleview on the west. The site was known as the VanTyle Redevelopment project and Brush Creek Plaza plan. Last year the applicant requested that the ordinances that rezoned the property and approved the development plan (which would have called for an election by the voter), be repealed. In addition the ordinances which delayed the date of the elections should also be repealed with the project. Development of the project is not going to occur, therefore the ordinances should be repealed. Patricia Jensen, Assistant City Attorney, stated that the committee substitutes will repeal the ordinances which delayed the effective date of the election.

Eric Jensen, City Development stated the site is located at the northwest corner of N. Antioch Road and I-35. The purpose of the amendment is to allow renovation of a vacant restaurant building. The plan will be completed in two phases. Phase I will be the renovation of the existing building and restriping of the parking lot. Phase II will consist of removing the existing deck on the front of the building and replacing another building in its place. City Plan Commission and staff recommended approval. Dale Shulte, Attorney, Polsinelli & White concurs with staff's recommendation. Committee recommended approval of the ordinance with revised a plan.

Stan Barrett, Housing Community and Development Department stated the ordinance will authorize execution of a memorandum agreement with the Missouri State Historic Preservation Officer, the Advisory Council on Historic Preservation and the Land Clearance for Redevelopment. This is for the Little Sister's of the Poor complex located at 5331 Highland. The complex was designated as a dangerous building in 1994. A $700,000.00 grant has been received from the Department of HUD for demolition and possible redevelopment for the area. Committee recommended approval.
