Joe Rexwinkle, City Planning and Development, gave the staff report on the Ordinance. The applicant proposed renovation and expansion of the existing structure for a mixed use project consisting of ground level nonresidential uses and upper level residential uses. The developer is seeking incentives under a previously-approved PIEA plan which requires rezoning to District UR. The area was recently rezoned to DX-15 in support of the streetcar and the Greater Downtown Area Plan recommends the same zoning, therefore the applicant is proposing the same permitted uses and lot and building standards as those found in DX-15.

Patty Noll, City Planning and Development, gave the staff report on the Ordinance. The request was to amend a previously approved MPD plan to allow a development of a community center (under construction), adult daycare center, and multi-family development (senior housing). Ms. Noll did note that concern had been expressed by property owners regarding construction of parking lots on the west side of Wabash Avenue. On April 18, 2016, the Key Coalition Neighborhood Association communicated to the applicant and staff regarding a request for continuance. The applicant appeared at City Plan Commission on April 19 and requested that the case be heard, offering to remove properties located on the west side of Wabash from the MPD plan. However, Peter Hoffman, representing Legal Aid, requested that the case be continued, as there were no other neighborhood association representatives present. City Plan Commission voted 4-1 to hear the case, with revision of the plan to delete those lots located west of Wabash Avenue and subject to additional conditions.

Patty Noll, City Planning and Development, gave the staff report on the Ordinance. Kansas City’s Zoning & Development Code, Chapter 88, became effective January 1, 2011. The purpose of the document is to state, depending upon the zoning classification assigned to every parcel in the city, how each property may be used – whether for residential, commercial, or industrial purposes. Within these broad groups, specific uses are further defined. The code also contains lot and building standards dictating lot size, setback, height, and density. For certain uses, performance standards are required. Review and approval procedures are outlined, ensuring participation by the public and a fair and timely review of development proposals. The regulations apply to all development, whether private or public. T he current code is the result of a major revision of the City’s first zoning ordinance, enacted in 1926 and not significantly revised until 1970 to accommodate development of land annexed for the airport. Major improvements with the “new” code include the stream buffer ordinance, landscaping standards, enabling legislation for overlay districts, bicycle parking requirements, lighting standards, and revised signage requirements. Even with recent improvements to the code, however, it is important to regularly assess and revise text. Revisions may codify standards of the city’s area plans or simply enable new development concepts. Staff, on a periodic basis, meets with the development community, neighborhood groups, and internal users to discuss new concepts as well as necessary clarifications and revisions to Chapter 88 – the purpose of the “periodic review”. Among many other revisions, the current Ordinance 160341 contains the following of note: • Revision to allowed uses in the Manufacturing Districts to allow Warehousing, Wholesaling, and Freight Movement (Outdoor) as a special use in M1 and permitted uses in M2 and M3 (subject to other regulations and standards). • Accommodate wind energy systems in the code, as solar is currently considered. • Require expansion of vehicular use areas to comply with the Boulevard and Parkway standards. • Require submission of a site plan for private open space tracts (provided to meet parkland requirements and buffer/setbacks) • Require certification of a registered landscape architect that all landscaping materials shown on an approved plan have been planted.
