Authorizing the City Manager to enter into a funding agreement with the Planned Industrial Expansion Authority of Kansas City, Missouri in an amount not to exceed $3,500,000.00 for blight remediation in the Armour-Gillham PIEA Planning Area.

Claude Page, City Planning and Development, gave the staff report on the ordinance. It was noted that this is a companion to Ordinance 180496. The agreement would provide for an allocation of $3,500,000 from the Midtown TIF Surplus Fund. The Project will redevelop four corners of the intersection of Armour Blvd. and Troost Ave. simultaneously. In previous action, on January 21, 2016, Council passed Ord. 16005, authorizing expenditure of $1,000,000 toward purchase of properties for this Project. All payments will be subject to appropriation by the City, availability of funds within the Midtown TIF Surplus, "no-dark" provisions for Costco, Sun Fresh and Home Depot, and compliance with any other requirements of the funding agreement.

RESOLUTION - Amending the Midtown Plaza Area Plan by changing the recommended land use map in an area generally bounded by Ward Parkway on the north, State Line on the west, Troost Avenue on the east and 55th Street on the south, by changing areas designated for residential medium land use to residential low land use. Gerald Williams, City Planning and Development, gave the staff report on the resolution. Staff has discovered a large area on the Midtown Plaza Area Plan Recommended Future Land Use Map which was apparently mistakenly assigned the wrong land use designation. There is a large area recommended for Residential Medium land use in an area generally bounded by Ward Parkway on the north, State Line on the west, Troost Avenue on the east and 55th Street on the south. The land use recommendation for this area was changed from Residential Low to Residential Medium apparently just before the plan was adopted. Staff believes this change was made in error.

Authorizing the City Manager to execute a Development Agreement with 1729 Grand Boulevard, LLC, with respect to the development of the property located at 1729 Grand and the historic Kansas City Star Building.

Kerrie Tyndall, City Manager's Office, gave the staff report on the ordinance. The Development Agreement provides for certain incentives to be extended to the project. Those incentives include EEZ tax abatement not to exceed 75% for fifteen years and 50% for five years, and a financial contribution equal to 50% of the earnings taxes generated at the project site, plus one and one-quarter percent (1.25%) of the annual taxable sales made at the project site until the earlier of twenty-five (25) years or until the developer has been reimbursed half of the redevelopment costs, not to exceed approximately $39.6 million. All incentive levels are subject to the AdvanceKC process. If the AdvanceKC process indicates that a smaller financial contribution is warranted, the Development Agreement will be revised accordingly or terminated.

 1. Staff from the City Auditor's Office and City Planning Department will present an ARTS report for the Arterial Street Impact Fee Ordinance Should Be Amended to Correct Structural Imbalance audit.
 
 Doug Jones, City Auditor's Office, addressed the Committee. In February 2017 the City Plan Commission warned the Mayor and City Council that the current arterial street impact fee ordinance was not keeping pace with development in the City. The audit focused on whether the City would benefit from increasing the arterial street impact fees in accordance with Chapter 39 of the Code of Ordinances. The City Auditor's Office recommends modification of Chaper 39 of the Code of Ordinances to make the arterial street impact fee program sustainable.
 
 2. There may be general discussion regarding current Planning, Zoning and Economic Development issues.
 
 3. Pursuant to the following subsections of Section 610.021 of the Revised Statutes (1) legal matters, litigation, or privileged communications with attorneys of Missouri, there may be a closed session to discuss: , pursuant tosubsection 1; (2) real estate, pursuant to subsection 2; (3) personnel, pursuant to subsection 3 and 13; and/or (4) sealed bids or proposals, pursuant to subsection 12.
