Patricia Noll, City Planning and Development gave the presentation for this ordinance along with Lisa Briscoe of the Midtown Plaza Area Plan (MPAP) Implementation/Bowl Sub-committee. This plat approves a Special Character Overlay to be known as the Plaza Bowl Overlay District, which includes use and height regulations for the area generally located on the south and north sides of W. 47th Street between Madison Avenue on the west and J.C. Nichols Parkway on the east. This ordinance reduces the contingent appropriation in the amount of $10,000.00 and appropriates $10,000.00 from the Unappropriated Fund Balance of the General Fund for the purpose of educating the public about the requirements of this ordinance. The Plaza Bowl overlay purpose is to implement the Midtown Plaza Area Plan. The Bowl Concept originated with the 1989 Plaza Urban Design and Development plan. The Bowl concept emerged as the plaza area developed in the 1920's and 30's with the low rise buildings of the Country Club Plaza being surrounded by high-rise buildings. The MPAP was adopted in 2016 which reaffirmed the Bowl Concept. The goal of this plan is to preserve the original and unique planning and urban design concepts that embody the Country Club Plaza and surrounding areas. Whereas new development and future expansion would have to follow suite. This would regulate height and land uses. Patricia stated that on January 18, 2018, the Main Corridor Overlay was passed. This overlay includes certain properties within the MPAP and regulates uses and heights. Jim Wanser , Joe Montenary, Jamie Closson, Dan Cofran, John Eggert, Steven Rueter, Carol Thrane, and Robert Martin provided public testimony of approval of this ordinance. A digital copy of all provided presentations, handouts, and documents can be found in the City Clerk’s Office. Patricia Jensen and Jim Bowers, Rouse Frets White Goss Gentile Rhodes P.C., provided a presentation in opposition of this ordinance . Mrs. Jensen and Mr. Bowers represent the property owners of the Skelly Building (Plaza Skelly Group LLC) and The Plaza Medical Building (Metcalf Continuing Members LLC). Mrs. Jensen stated that these property owners are being directly impacted by this ordinance. The Skelly Group LLC are requesting to amend the ordinance to provide for a height limitation that exists to the south of the Skelly building. The Metcalf Continuing Members LLC is requesting 4 to 10 stories, provided under the 1989 Bowl Concept. A complete copy of this presentation can be found in the City Clerk's Office. Aaron March, Rouse Frets White Goss Gentile Rhodes P.C., provided a presentation in opposition of this ordinance. Mr. March is representing the property owner of Commerce Bank and subsidiary properties. Mr. March is also requesting to amend the ordinance to provide for a height limitation of 60 ft. or 6 stories for the Commerce Building. A complete copy of this presentation can be found in the City Clerk’s Office. Doug Price, resident of the plaza, provided public testimony in opposition to the ordinance. Stating the ordinance is redundant and the proposed process is corrupt. Pat Daniels, 7th Church of Christ Scientist, provided public testimony in opposition of this ordinance. Mr. Daniels stated that 7th Church vigorously opposes this ordinance because the height regulations were dictated by adjacent property owners.

Spruce Avenue to allow for a senior living facility. This development plan will be called Evergreen Terrace and will have 50 units with under 52,000 ft and 57 parking spaces. Aaron March, on behalf of Sixth & Garfield Redevelopment Corporation, provided testimony for this ordinance. Mr. March stated that the Century Plaza Building is being sold and in accordance with the 353 contract, the City must be notified first. Mr. March stated that this ordinance authorizes the City to approve the assignment. Once this ordinance is approved the sale would be closed in February so more money can be brought in on the project. The City leases this building with the Fire Marshall. This ordinance approves an assignment and assumption agreement relating to the Sixth & Garfield 353 Redevelopment Contract among the Sixth & Garfield Redevelopment Corporation, Hopkins Holding, Inc., and the City of Kansas City, Missouri.

The applicant is requesting a vacation of this street because the property owner often shuts down Rochester Ave for events which require a street closure permit. By vacating this street a street closure will no longer be required and the street can be permanently closed at the leisure of the owner. This will simplify the liquor and other licensing processes for the venue and will approve the experience for patrons of Knuckleheads Bar. This ordinance vacates the east/west street of Rochester Avenue from the east line of N. Montgall Avenue to the west line of N. Chestnut Trafficway. This will retain a utility easement, providing for reversion if certain conditions are not met.

Zach Nelson, City Planning and Development, provided the presentation for this ordinance. This vacation will allow the reconfiguration of the traffic patterns on 47th and 48th street to provide a larger and safer pedestrian area. It will also service a traffic calming measures and provide clear driving actions for drivers. City Planning recommends approval of this ordinance. John Eggert, representing Country Club Plaza JV LLC from Taubman Company, added that this vacation is part two of the Nordstrom development plan that was approved a few weeks ago. This ordinance vacates a portion of Jefferson Street between 47th Street and 48th Street. This will reduce the contingent appropriation in the amount of $10,000.00, appropriate $10,000.00 from the Unappropriated Fund Balance of the General Fund for the purpose of educating patrons and residents of the Country Club Plaza about the Nordstrom store to be located at 4720 Jefferson Street, including design, access issues, and construction timelines.
