Approving the Fifth Amendment to the Redevelopment Plan submitted by the Forty-Sixth and Madison Redevelopment Corporation and authorizing the Director of Finance to enter into a Fifth Supplementary Contract with the Forty-Sixth and Madison Redevelopment Corporation.

John Eckardt, City Planning & Development, stated ordinances 991068 and 990962 are companion cases. Ordinance 991068 is for approval of the fifth amendment to the 46th & Madison "353" plan. Ordnance 990962 will approve the amendment to an existing limited district preliminary plan. The purpose of the plan amendment is to extent the construction timetable for stages 2 and 2A. The proposal will also extend the construction timetable by five year for each phase. Construction will now be completed by the year 2007. The Redevelopment Coordinating Committee (RCC) and City Plan Commission recommended approval of the plan. A committee substitute was submitted on ordinance 990962 to add a condition to include dedication of right of way for Madison Avenue. Howard Barewin, Attorney, Blackwell, Sanders 2300 Main. Mr. Barewin, agreed with staff's recommendation.

Authorizing execution of an agreement for Kansas City to lease the property located between 2nd and 3rd from Oak to Grand from the Kansas City Transit Authority for a period of 20 years for a consideration of one dollar.

Bob Langenkamp, City Planning & Development Department, reported that the ordinance is for parking agreement which is part of a three party agreement with the City, Kansas City Area Transportation Authority and the Port Authority. The agencies had a common interest in property located at the northeast corner at 3rd & Grand. The City through the City Market needed additional parking in the area The lease agreement will allow the city to lease the property from ATA for $1. Public parking will be constructed on the lot and the Market Manger of the City Market will be responsible for maintenance and up keep of the parking lot. Councilman Ford asked who is responsible for building of the parking lot. Mr. Langenkamp stated the parking lot will be built under the direction of the city. Committee recommended approval of the ordinance.

Accepting the recommendations of the Tax Increment Financing Commission as to the Sixth Amendment to the Eleventh Street Corridor Tax Increment Financing Plan; approving the Sixth Amendment to the Eleventh Street Corridor Tax Increment Financing Plan; and designating an Expanded Redevelopment Area.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "DO PASS"
Ordinances 991015 and 991016 are companion cases. Laura Whitener, Economic Development Corporation/Tax Increment Financing Commission. The eleventh street corridor is located between 6th street, Wyandotte Street, 13th & Bee Line Street and I-29. The amendment would expand the boundaries of the TIF plan to include the balance of the property. The plan is in conformance with the FOCUS plan. Councilman Nash expressed concerns of why all the property within the expanded redevelopment area was not included in the project. Steve Taylor, Vice President of DST Realty, spoke on behalf of the project explaining to the committee the circumstances of why DST being able to negotiate acquisition on certain property. Jeff Maloney, Attorney, TIF Commission, spoke in support of the project. Rhonda Smiley, Smiley Law Firm, Attorney, spoke in opposition she felt that her client Mr. Carpenter has been "left out of the process" and because of the inclusion of his property within expanded redevelopment area. Hand-outs are on file in the City Clerk's Office.

Approving and designating Redevelopment Project Y of the Eleventh Street Corridor Tax Increment Financing Redevelopment Plan, as amended, as a Redevelopment Project; and adopting tax increment financing therein.

Project Y is one of a series of project included in the eleventh street corridor which consist of two phases. The first phase consist of a five story office building, a multi story 1,300 space parking facility and possibly restaurant space. Also see comments for ordinance 991015.
