Approving the preliminary plat of Buehre-Edwards Subdivision on approximately a 36.06 acre tract of land generally located at the northwest corner of E. 87th Street and Rhinehart Road. (SD 0886)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "HOLD ON AGENDA"
Patricia Jensen, Assistant City Attorney introduced a committee substitute which adds in certain conditions of the ordinance. Don Gustafson, City Development Department, stated that the request is for a preliminary plat of three single family lots which is located at the northwest corner of Rhinehart Road and 87th Street. The property is currently undeveloped and is being used for livestock. The applicant wants to construct a home on the property and to split up one lot into three lots. Rhinehart Road is classified as a secondary arterial on the city's major street plan, which is unimproved which is a two lane asphalt road with open ditches. Staff has concerns regarding lots being created, because more public services will be needed. City Plan Commission approved the plan subject to certain conditions. Joshua Buehre, applicant, 8621 Rhinehart Road, KCMO. Mr. Buehre stated that he was in agreement with all of the conditions except for the filing a final plat. He stated, after the City Plan Commission meeting he received a bid from a land surveyor for $8,000.00 in which he thinks it would be cost prohibited. He went on to say that out of three tracts of land only one tract belongs to him. He requested that lot #2 be approved through the preliminary plat. Patricia Jensen, Assistant City Attorney, stated that the Subdivision Regulations do not allow creation of lots less than 20 acres without platting through the subdivision process and it would be impossible to do. Councilman Ford recommended that the committee hold the ordinance for a couple of weeks see what changes can be done.

Amending Chapter 80, Code of Ordinances, by repealing Section 80-203, District MR (materials reprocessing district), and enacting in lieu thereof one new section of like number and subject matter.

Ordinances 991296 and 991297 are companion cases. Don Gustafson, City Development stated that the location of the project is on the north side of Bannister Road approximately 600 feet east of Valley Garden Drive. Ordinance 991296 will rezone from RA (Agriculture) to R1a (single family) . Ordinance 991297 will approve a Community Unit Project (CUP) to allow 107 single family lots. Currently the site is heavily wooded . The development was approved by City Plan Commission in 1998 and heard by the committee (PZE&D) and during that time the committee requested additional drainage information. Michael Burke, Attorney, stated that he is in agreement with all of the conditions that are in the ordinance. The property that is to be developed is high ground and rugged. Portions of the area is open and heavily wooded. In regards to a drainage plan engineers came up with a idea to acquisition of additional five acres tract for the purpose of providing detention. At City Plan Commission there were Several objections were raised at the plan: 1) drainage issues; 2) aesthetics of detention base; 3) environmental concerns and 4) drainage plan. Area residents spoke in opposition of the project due to water drainage problems and traffic issues: Greg Cheffee, 9455 Valley Garden Road; Brian Klapmeyer, 9305 Valley Garden Road; Shirley Allen; 9435 Valley Garden Road; Patricia Long, 9425 Valley Garden Dr.; Lisa Cole Price, 9409 Valley Garden Dr.; John Vansant, 9205 Valley Garden Dr. and Dale Busse, 13783 Lookout Dr. Committee recommended to hold ordinance off the agenda.

Lee Dixson, Public Works Department, stated that the ordinance will approve the plat for Farmland Industries Corporate Headquarters. The commercial development is located at Highway 291 & I-29, which is a lot development with two detention tracts which was designed because the development is located in two watersheds. All of the grades and closures have been checked and he recommended approval. Ralph Bellar, Attorney (representing Farmland), concurs with staff's recommendation.

Lee Dixson, Public Works Department, gave an overview of the ordinance. The plat is a nine lot development located at NE 63rd Terrace and N. Cypress. The development was required to submit a storm drainage study to improve the arterial streets to provide measures for silk erosion. All of the grades and closures have been checked and he recommended approval.

Approving the development plan submitted by the Hospital Hill Redevelopment Corporation for the Longfellow Heights III Project on an approximately 3.8 acre tract of land generally bounded by 26th Street on the north, Troost Avenue on the east, 27th Street on the south and Harrison Street on the west; declaring the area included in such plan to be a blighted area and its redevelopment necessary for the preservation of the public peace, prosperity, health, safety, morals and welfare; authorizing the Director of Finance to enter into a contract with the Hospital Hill Redevelopment Corporation; and authorizing certain tax abatement within the plan area.

Councilman Ford stated that the ordinance was held because of concerns regarding the storm drainage issues in Line Creek. He stated that the Water Department and Public Works Department agreed to give a report to the committee regarding the drainage problems. There was no further discussion on the ordinance. Committee recommended that the ordinance be passed.
