Vince Hustead, City Planning, explained that this is an application for a preliminary plat for converting a existing apartment building to for sale condominiums. The property is located at 50th Street between Walnut and Main. Mayor Barnes asked for clarification of the location. Marshall Blunt,applicant, descripted the location further and its surrounding landmarks. He asked for advancement.

Travis Kiefer, Public Work, testified regarding the Atriums East at SoHo West. He said that this was a standard plat and the the grades, easements and right of ways had been checked and approved. Patricia Jensen, White Goss, representative for the applicant was present she requested an advance.

Accepting the recommendations of the Tax Increment Financing Commission as to the First Amendment to the Country Club Plaza Tax Increment Financing Plan; approving the First Amendment to the Country Club Plaza Tax Increment Financing Plan.

Stan Counts,EDC, stated that this is an amendment to the budget for the Country Club Plaza TIF project. The project in question is for a boutique hotel. Erin Detrickson, Blackwell, Sanders, representative for the applicant was present. The hotel is well underway and this ordinance is an administrative effort to have the budget reflect its current usage. It does not change the distribution of funding, it sources or the amounts.

Edgar Jordan,Property and Relocation, explained that this ordinance represent the accepting of 100 properties for the downtown arena project. There is still one property whose owner lives out of state and they are currently in negotiation with them.

Travis Kiefer,Public Works,stated that the ordinance before the committee was for the Falcon Falls replat, a Platte County project. Tom Polk, representative for the applicant, was present and stated that the project was near completion and nearly all units were sold. This ordinance addresses administrative issues so that owners can close of their indivial units.

RESOLUTION - Approving the reappointments of Frederick Riesmeyer and Jim Wilson to the Industrial Development Authority of the City of Kansas City, Missouri.

Mayor Barnes testified that this ordinance was for the reappointment of two members to the Industrial Development Authority. This is again an administrative matter.

Approving the plat of Kansas City Hospice, an addition in Kansas City, Jackson County, Missouri; accepting various easements; establishing grades on public ways; authorizing the Director of Public Works to execute certain agreements; and authorizing the City Clerk to file this ordinance and attached agreement.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS AS A COMMITTEE SUBSTITUTE, DEBATE"
Travis Kiefer,Public Works,testified that this ordinance was for Kansas City Hospice, it would create one lot and one plat to construct a hospice and the dedication of part of Martha Truman Road. Dave France', representative for the applicant was present and commented that they respectfully require that the road dedication be eliminated from the requirements of the ordinance. This hospice would be a place for people to live out their final days and he added a heavy traveled road would take away for the quite environment that the applicant envisioned for the hospice. Councilman Fairfield questioned whether the road dedcation was necessary. Travis Kiefer said that he didn't think the road dedication was not neccessary. There was discussion about a compromise. Staff, the Committee and the applicant came to an agreement. They would consider this a request for a wavier on road dedication. Virginia Walsh stated that she believed that the road would not be needed and would cause a change in the determined use that would not be condusive to the hospice and the surrounding area. A committee substitute was proposed to add condictions 7 and 8. They would remove the requirement of the road dedication.

Travis Kiefer,Public Works, Replat of lot 1 of Maple Woods Community College property, Jeff Allan is the representative for the applicant he stated that this ordinance would allow SWB to use a greater portion of the property owned by Maple Woods for their tower. The college would get a portion of property closer to it's current entrance and SWB would get a larger and less intrusive piece of property for their tower.

PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS AS A COMMITTEE SUBSTITUTE, DEBATE"
Larry Stice, City Planning, and Bob Long, EDC, explained the need for the substituted for 050241 not restricting light industrial use. Larry Stice, stated that the wording would not discourage mix use. Mayor Barnes expressed concerns that would restrict development of residential if the light industrial use was included in the ordinance. She believes that the City would be better served if “light industrial” were taken out of the ordinance. There was some discussion regarding whether that portion of the ordinance should be left in or taken out. The Mayor suggested that the ordinance should be held and visited again later to see if the market supported a more toward either light industrial or residential. The consensus of the committee is that by leaving in the “light industrial” portion of the ordinance it would limit the committee ability to oversee the development in the area. Councilman Fairfield suggested that the ordinance be held so that parties could work on a compromise. Bob Long, EDC, LCRA, stated that a proposed tenant for the project area is interested in having the ordinance move forward they do have a timing issue. Tom Levitt, Business Owner in Crossroads Area, testified that some of the artist in the area could be considered light industrial user. However MIX use may restrict them or even cause them to move to another area. Larry Stice stated that LCRA would like to have governing power to restrict zoning and design guidelines. Tom Levitt, stated that he speaks for the Crossroads Community Association. The group is happy to follow guidelines for frontage landscaping and parking requirement but would now like to have to do interior landscaping. He added that the guidelines would cause the business to loss parking spaces and cause other difficulty for them.

RESOLUTION - Amending the Downtown Industrial Area Plan for an area of approximately 42 acres generally bounded by 18th Street on the north, Cherry Street and the north-south alley east of Cherry Street on the east, 20th Street and the KC Terminal tracks on the south and the north-south alley west of Grand Boulevard on the west, to allow for an expansion in allowed uses by changing the recommended land use from light industry and mixed use to mixed use (residential, commercial and light industrial).
