Oloufu Agbaji, City Planning and Development, gave the staff report for the Ordinance. The applicant is requesting an amendment to a previously approved Chapter 80, CP-3 development plan in District B3-3 (Community Business 3-3), to allow for an outdoor go-kart track. Sports and Recreation, Participants is permitted in District B3-3, which is the site’s Chapter 88 zoning designation. The current approved development plan showed future building addition to the west of Building J (former Best Buy). The change in use to allow the outdoor go-kart track necessitates approval of the amended development plan. The go-kart track is located on the west side of the building, about 310 feet from the south property line (NW 82nd Street) and 110 feet from the west property line (Hwy 196). The theater, just south of this site has been demolished, but the parking is still in place. The parking lot for the theater is located 20 feet from the south property line. The plan proposes 6’ wrought iron fence with 4” block and brick columns on the northern edge of the site. The wrought iron fence will continue along the western edge of the track. The plan shows a 6’ high chain link fence along the south edge of the track.

Sarah Anzicek, City Planning and Development, gave the staff report for the Ordinance. The street rights of way to be vacated lie north of E. 23rd Street Trafficway, just east of the J.A. Rogers Elementary school and about a mile west of Interstate 435. There are two street portions proposed to be vacated. The first is Bennington Avenue from E. 19th Street on the north to its terminus on the south, which is where it intersects with E. 23rd Street Trafficway. The second piece is E. 21st Street from its intersection with Bennington Avenue on the west to where it meets the remainder of E. 21st Street on the east, which was previously vacated. All of the roads are essentially “paper” streets that were never constructed. All of the land immediately surrounding the proposed streets is vacant, but some residential development is found on the northern fringe. There is no access to the constructed E. 23rd Street Trafficway or to the constructed Bennington Avenue north of E. 19th Street. The applicant wishing to vacate these streets owns most of the property abutting the rights-of-way. The Kansas City, MO School District owns one parcel abutting the streets. The only consent received to vacate these streets was from Clarkson Construction. The School District was asked to consent to the vacation but declined the request. The School District was not informed as to the future development intent, and this was the reason for not giving consent. The City’s Code requires that consent of the owners of ¾ of the property fronting the proposed vacation be acquired for the vacation to pass. Clarkson Construction owns 85% of the property fronting the proposed vacation.

Patty Noll, City Planning and Development, gave the staff report on the Ordinance. Since 1975, the zoning ordinance has included time restrictions on when a certificate of legal nonconformance may be filed after a property has been deemed nonconforming, either through a zoning ordinance text amendment or rezoning. The intent of nonconforming regulations is to clarify the effect of the “nonconforming” status and avoid confusion with illegal buildings that were constructed and uses that were established in violation of zoning regulations.

An agreement was made between all parties to support the companion Ordinance 140185. In order for Ordinance 140185 to approve the Eleventh Amendment to the Southtown Corridor/31st & Baltimore TIF Plan to be executed, the City must waive its right to additional reimbursements in the amount of $831,059.82. The City anticipates receiving $2,825,964.01 in the current fiscal year. Chairman Ford infomred the Committee that this would be held for more infomration to be passed amongst the interested parties. He asked for specific taxing jurisdictions to go on record regarding whether or not they support the Ordiannces.

The Redevelopment Area contains two noncontiguous areas which are (A) generally bounded by 59th Street on the north, 75th Street on the south, Holmes Road on the west, and Chestnut on the east (the “South Prospect/Troost Area”) and (B) generally bound Memorial Drive on the north, Wyandotte Street and Baltimore Street on the west, Main Street on the east, 31st Street on the south (the “31st & Baltimore Area”) all in Kansas City, Jackson County, Missouri. Chairman Ford infomred the Committee that this would be held for more infomration to be passed amongst the interested parties. He asked for specific taxing jurisdictions to go on record regarding whether or not they support the Ordiannces.
