Virginia Walsh, City Development stated the ordinance will rezone an area located at NE Barry Road & N. Troost to allow a one four- plex building, two tri-plex building and two duplex buildings for a total of 24 units. Staff and City Plan Commission recommended approval of the ordinance with certain conditions.

Larry Stice, City Development gave an overview of the ordinances. Ordinances 981178, 981179 and 981180 are companions. Ordinance 981178 will delete 2.41 acres, ordinance 981179 will rezone 2.41 acres to R-1b and ordinance 981180 will approve the community unit project located on N. Ames and NW Englewood Road. Committee recommended approval of the ordinances.

Patricia Jensen, Assistant City Attorney, stated committee substitutes have been prepared on both ordinances (981101 & 981102) to revise legal descriptions.
Eric Jensen, City Development Department stated the site is located in the northland at the north end of Hwy 291 and I-35 west of the Amber Meadows subdivision. Approval of the ordinance will rezone approximately 63 acres.
Mr. Bacchus stated expressed concerns regarding the distance between a house and the property line. Twenty feet is enough space to create year around screening. Therefore additional set-back is not required
There were interest expressed regarding access to one of the property owners
Mike Burke, attorney stated that number seven condition made suggestions that since there are no sidewalks a non funded deferral agreement in which sidewalks would be constructed.
