Authorizing traffic signal modifications at Truman Road at Baltimore; reducing an appropriation in the amount of $73,609.00 in the General Fund; estimating revenue in the amount of $147,219.00 in the General Fund; and appropriating the sum of $220,828.00 to the Truman Road at Baltimore account of the General Fund.


OPERATIONS COMMITTEE recommends "DO PASS"
Jere Meredith, Public Works, was present to testify on behalf of this ordinance. He stated that this ordinance would set up accounts for traffic signal modifications at Truman Road and Baltimore. Mr. Meredith requested approval.

Authorizing an STP-Urban Agreement with the Missouri Highways and Transportation Commission relating to rehabilitation of the 12th Street Bridge over Burlington/Northern Railroad Tracks.


OPERATIONS COMMITTEE recommends "DO PASS"
Stan Harris, Public Works, was present to testify on behalf of this ordinance. He stated that this ordinance would authorize an agreement with Missouri Highways and Transportation Commission relating to rehabilitation of the 12th Street Bridge. Mr. Harris requested approval of the ordinance.

Giving permission to Original Bread, Inc., to construct and maintain a projecting business advertising sign, steps and a fenced patio in the public right-of-way for the building at 4700 Pennsylvania Avenue; assessing an encroachment fee of $13,850.00; and estimating $13,850.00 in revenue.


OPERATIONS COMMITTEE recommends "DO PASS"
Barry Archer, Director, Codes Administration, was present to testify on behalf of this ordinance. Also present was the developer, Mark Babich. Mr. Babich requested that the committee waive the encroachment fee for this project. He stated that the city failed to calculate the use of the property, that a precedent had been set with Sulgrave Corporation and that he was actually improving city property. Councilmember Nace asked if this had anything to do with the sidewalk cafe ordinance. Mr. Archer stated that this project was entirely different. He stated that the applicant was erecting a fence and a stepped area. Councilmember Nace asked if there was a precedent for the waiving of encroachment fees. Councilmember Eddy asked for further information regarding the improvement amount to the sidewalk. Mr. Babich answered that the 3 1/2 feet of inlaid brick that he was expecting to build would cost about $30,000 - 40,000. Councilmember Eddy moved for a committee substitute to waive the encroachment fee. The motion died for lack of a second.

Amending Chapter 64, Code of Ordinances, by repealing Section 64-161, Prohibited acts, exceptions, and fees, and enacting in lieu thereof a new section of like number and subject matter.


OPERATIONS COMMITTEE recommends "DO PASS"
Stan Harris, Public Works, was present to testify on behalf of this ordinance. He stated that this ordinance would eliminate the fee for hanging banners in certain areas. He stated that this was cost restrictive for many small neighborhood associations. Councilmembers Nace and Hermann expressed their pleasure with this ordinance.

Authorizing a $3,240,614.95 contract with Radmacher Brothers Excavating Company, Inc., for the work of removing and replacing the existing Saint Louis Viaduct over the Kansas City Terminal Railways; authorizing a $404,543.00 Sixth Amendment to Agreement No. 920770 with TranSystems Corporation that provides construction observation services; estimating revenue in the amount of $2,000,000.00 in the Capital Improvement Fund; reducing an appropriation in the amount of $1,500,000.00 in the Capital Improvement Fund; and appropriating $3,500,000.00 to the St. Louis Viaduct account of the Capital Improvement Fund.
