Giving permission to the 4646 Broadway, L.L.C., to construct and maintain an excavation shoring system for the building at 4610 Broadway; assessing an encroachment fee of $5,000.00; and estimating $5,000.00 in revenue.


FINANCE AND AUDIT COMMITTEE recommends "DO PASS AS A COMMITTEE SUBSTITUTE"
Representative from City Development, he explained the location of the encroachment. A representative for the developer requested that the fee be waived or reduced for the encroachment. He stated that the developer is not receiving any incentives and the fee may prove to be a hardship. He also said that even if the City had a need to go into the sewer for repairs and would like to have the cost to cover that would be well under $17,000. Stan Harris said that $5,000 would be suffienct to cover the cost in the invent that repairs were needed. The original formula used to arrive at the fee was based on the properties value. But because the developer is not occupying above ground the committee, the developer along with staff agreed that $5000.00 would be a good compromise.

Condemning and taking private property in fee simple for public purpose for construction of a fire station located in the vicinity of Blue Parkway and Elmwood Avenue, in Kansas City, Jackson County, Missouri; providing for the payment of just compensation therefore; authorizing continued negotiations by the Director of City Planning and Development; consenting to the filing of the petition for condemnation by the City Attorney, on behalf of the City, and directing the City Clerk to cause this ordinance to be recorded in the office of the Recorder of Deeds for Kansas City, Jackson County, Missouri.

This ordinance grants authority in Section 70-38 of the Code of Ordinances, City of Kansas City, Missouri, to the Director of the Public Works Department has made and filed with the Director of Records temporary traffic regulations described on a test basis: Numbers 58405 through 58428 and notice has been given thereof to the public by publishing regulations in The Daily Record and the Council has duly considered the regulations and has found it in the public interest and necessary to the public safety that said regulations and each of them continue in effect as a part of Chapter 70 of the Code of Ordinances, and as a part of said sections of said chapter to which the respective regulations refer to City Council and ordained by such.

Calling for submission to the voters of Kansas City, at a special election to be held on August 8, 2006, a question amending the Charter of Kansas City by repealing its current twenty articles and enacting thirteen new articles to be known as the Charter of the City of Kansas City, to reflect the home rule authority granted by the Missouri Constitution; to require elected officials be residents of the City immediately prior to their election; authorize the delegation of duties among City departments; to authorize the establishment of new park districts; to re-establish the Internal Auditor as an appointee of the City Manager; to accelerate the adoption of ordinances by requiring two rather than three readings; to require the establishment of debt and economic incentive policies; require decennial review of the Charter; to authorize the Council to impose payments in lieu of taxes on enterprise departments of the City not to exceed 10% of the department’s gross revenues; and provide for other municipal purposes; fixing the dates when the amendments shall take effect; directing the City Clerk to notify the responsible election authorities of the election on or after May 26, 2006, but not later than May 30, 2006; and recognizing this ordinance to be an emergency measure.
