PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "IMMEDIATE ADOPTION"
Peter Schlesinger, City Planning, explained that the four steps involved in approving the resolution and three ordinances. He stated that it is necessary to complete the plan for this project. 1. The resolution modifies the land use. 2. Makes changes in 40 Hwy. 3. Makes changes to the Southeast corner of the project altering the intersection. 4. The final ordinance allows the mini storage portion of the project. Councilman Fairfield, asked if the pawn shop near the project would remain? Peter Schlesinger answered, Yes, the pawn shop would remain but they would make improvements to the buildings exterior including, surface texture treatment to the facade, landscaping and non intrusive lighting. There was discussion regarding the issue of storm water pond vs underground storm water retention system. Staff recommends the underground system. The Developer and owner would prefer the pond system. The underground system would be more costly. The developer agreed to the condition for underground system.

Virginia Walsh, City Planning, explained that location of the preliminary plan for the project known as Oak View near Northland Cathedral. The Project will be in 2 phrases and will include 65 foot lots. There were no objections to the plan. Representatives for the developer was present.

Approving an amendment to a previously approved development plan in District PD/R-5 (Planned District/High Apartments) on approximately a 6.75 acre tract of land generally located on the east side of State Line Road at W. 123rd Street (12301 State Line Road). (9745-PD-5)

Virginia Walsh, testified that this project will be on a 7 acre tract of land that will allow improvements The Boys Hope, Girls Hope. The new facility will accommodate 8 boys. She added that the terrain of the site would limit the visibility of the new building but the building will look very much like any other home in the area. Gary Christ, Director of Boys Hope/Girls Hope added that the children ages 12-18 will be supervised by 3 staff persons 24 hours a day. Warren Walter, resident, expressed concerns about the facility. The children are not restricted or restrained. The children are there on a volunterary bases and do not have behavior problems.

Virginia Walsh, City Planning, stated that there were 4 condition of the ordinance for this preliminary plat. 1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations. 2. That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri Licensed Civil Engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to the City Engineer Office prior to approval and issuance of any building permits, and that the developer construct any improvements as required by the City Engineers Office. 3.That the developer secure permits to reconstruct or construct sidewalks, including curb, gutters, and catch basins along all project frontage as required by the Department of Public Works prior to recording of the plat. 4.That the developer submit the condominium declarations, covenants and restrictions to the Law Department for approval. It is further determined that a copy of the preliminary plat be filed in the office of the City Clerk under Document No. 040056. Approval is depended upon the Council's findings.

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0539, rezoning an area of approximately 4.6 acres at 4311 E. 58th Street from District R-5-p (High Apartments - Limited District) to District R-4-p (Low Apartments - Limited District), and approving a development plan for the same. Peter Schlesinger, City Planning, stated that the ordinance would allow a rezoning of the area for a group home. It would also allow an increase of the square footage of the two story structure to a total of 1550 which in turn will help to meet state requirements. William Kale, CEO, was present. Councilman Nash suggested that the item be held until there is been an opportunity to speak with Council persons Riley and Nace who's district is being affected by this project.

Virginia Walsh, City Planning testified that the property is located near Lee Summitt Rd. and 40 HWY. It is to be known as Arabian Hills and would include a new street with mid range size lots of approximately 67 ft. Representative from Flowers Survey stated that they were excited about the project and would worked to address any concerns. Janet Parrevechio, neighborhood association, expressed concerns about the proposed connecting roads elevation and suggested that the road not be built at this time. Representative from Flowers Survey suggested a compromise that would allow the road to be added at a later date and in a different location . The committee, developer and representative from the neighborhood association agreed to approve alternative B.
