Giving permission to QuikTrip Corporation to install and maintain a wrought iron fence, a sprinkler system, trees, planters, storm sewer inlet, electrical conduit and cables and a neighborhood marker in the City of Kansas City public right-of-way at 44th and Main Street.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Lee Dixson, Public Works Department, gave a overview of the ordinance. The new store will be built behind the existing Quick Trip. Quick Trip is asking for an encroachment into the city's right of way that will include an underground conduit. The irrigation system will water plantings along Main Street. The plantings within the right of way that will be maintained by the developer. There is a private inlet which encroaches into the right of way. A marker will be placed for the South moreland Neighborhood. Gary Broulette, Attorney, concurred with staff's recommendation.
 
 There will be a closed session to discuss Pending Litigation pursuant to RSMo Section 610.021(1).

RESOLUTION - Approving an amendment to the Martin City/Richard-Gebaur Area Plan, being that part of the City generally bounded by Blue Ridge Boulevard on the north, the Missouri/Kansas state line on the west, Grandview city limits on the east and the Cass County and Belton city limits on the south by modifying the Land Use Plan and Map in an area of approximately 75.4 acres generally located east of State Line Road, on the east and west sides of new Missouri Highway 150, north of new Missouri Highway 150 and north and south of relocated 135th Street to recommend "commercial district" instead of "mixed use district and industrial". Approving an amendment to a previously approved preliminary plan in District CP-3 (Regional Planned Business Center) on approximately a 75.4 acre tract of land generally located east of State Line Road, on the east and west sides of new Missouri Highway 150, north of new Missouri Highway 150, and north and south of relocated 135th Street, for the purpose of deleting an approximately 27.9 acre tract of land from said preliminary plan. Resolution 011553 and Ordinances 011554, 011555, 011556, 011557 and 011558 are related cases. Committee substitutes were submitted on each ordinance. Patty Noll, City Development Department, stated that the property for the project is located in south Kansas City within the Grandview School District at 135th & State Line Road at the new Highway 150. The commercial and industrial zoning was granted in 1986. No development has occurred on the site. The project covers about 125 acres. The Martin City/Richards Gebaur Area Plan calls for mixed use along 135th Street and Industrial Land Use for the remainder of the site. The property has been divided into five development sites. The purpose of the project is to approve commercial and industrial development plans. Ordinance 011554 calls for thirteen lots of retail commercial space to be built west of Highway 150 and south of 135th Street. Ordinance 011555 is located on the east side of Highway 150. Proposed are seven lots for a gasoline/convenience store/retail use and two restaurant/retail buildings. Ordinance 011556 is located on the north side of new 135th Street and on the north side of Highway 150 and is proposed to be a fast food restaurant. Ordinances 011557 and 011558 deals with the Industrial development of the plan. Ordinance 011557 is proposed for 35 acres located on the west side of Highway 150 south of the flood plain. Ordinance 011558 deals with the proposed remainder of the industrial development located on the east side of Highway 150 for a 15 acre tract of land. City Plan Commission recommended approval with certain conditions. There were some concerns expressed regarding the price per square foot for the shopping center space. Aaron March, Attorney, stated that Councilman Eddy is in full support of the project. He concurred with the conditions that are in the committee substitutes. The project was previously approved in 1985. This project is being brought up to today's standards.

Lee Dixson, Public Works Department, stated the plat is for a 1 lot commercial site located at Blue Ridge Blvd and 87th Street (within the Raytown/Kansas City, city limits). This will be the location for McDonalds Restaurant. The developer has complied with all of the requirements of the ordinance. There's an agreement that will defer the improvement of 87th Street. Sidewalks will be put in on the north side of 87th Street and the east side of Blue Ridge. Elaine Bowers, applicant, concurred with staff's recommendation.
