Rezoning an area of approximately 104 acres generally bounded by N.W. Barry Road on the south, N. Wyandotte Street on the east and Highway 169 on the west, and extending about 350 feet north of Metro North Drive on the north, from Districts B3-2 and UR to District UR, and approving a development plan that allows for redevelopment of the existing Macy’s building and construction of 900,000 square feet of mixed use commercial, hotel, theater, a golf entertainment complex and 150 residential units with 4,410 parking spaces, on 21 lots, in eleven (11) phases. PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS, DEBATE"
Olofu Agbaji, City Planning and Development, and Heather Brown, TIF Commission, gave the staff report on the Ordinance. It was noted that this is a companion to Ordinance 180020. This request is to consider rezoning about 11 acres on the north side of Metro North Drive and amend the existing UR development plan to include this tract. This will allow for a golf entertainment facility akin to “Top Golf” in lieu of the health and fitness facility proposed at the northwest corner of the site. The proposed UR development plan also serves as a preliminary plat allowing for 24 lots and three tracts. The three tracts consist of a detention tract and two POS tract. The revised plan does not show the future KCATA transit site per the prior approved plan. The plan proposes 10 foot building and parking setbacks allowing for a more urban development. The plan maintains the current road access points with slight modifications to the internal network, and provides an east-west drive with pad sites. This design creates six super blocks and nine pad sites. The development data summary below shows the proposed uses. Demolition of the entire mall is currently underway. The only remaining building will be the Macy’s store. Due to the change in grade of the property from north to south, the existing transition will be used to create a two-level shopping center. The plan shows a main street through the site that connects to east-west drive. The plan shows a village green along the internal drive between buildings P and O. The developer worked extensively with staff to revise the overall site layout several times to arrive at the current plan.

Accepting the recommendations of the Tax Increment Financing Commission as to the Tenth Amendment to the North Oak Tax Increment Financing Plan; approving the Tenth Amendment to the North Oak Tax Increment Financing Plan; estimating and appropriating the sum of $1,355,000.00 for the purpose of funding improvements to the Gorman Park Pool; and designating requisitioning authority.

The Tenth Amendment provides for (1) modifications to the description of the public improvements to be implemented pursuant to the Plan; (2) modifications to the Budget of Redevelopment Project Costs; (3) modifications to the Specific Objectives of the Plan to provide for the acquisition, rehabilitation and construction and equipping of a recreational facility and the construction of a sidewalk project and related public improvements; (4) modifications to the sources of funds to implement the public improvements contemplated by the Plan; and (5) the inclusion of all conforming changes within the Plan and Exhibits to the Plan that are in furtherance of the foregoing modifications.

Katherine Carttar, City Planning and Development, gave the staff report on the Ordinance. This ordinance would approve the addition of real property to The Villages Community Improvement District, and an update to the five-year plan. The District currently imposes a sales tax, not exceeding one percent (1%) upon all eligible retail sales within the District. This sales tax shall be imposed upon all eligible retail sales within the Additional Property. The District will continue to exist and function for a period of twenty (20) years commencing as established in Ordinance No. 141067.
