Amending Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 80-11A0036, rezoning an area of approximately 3.4 acres generally located at 8700 Leeds Road from District R-1a (One-Family Dwellings) to District RA (Agricultural). Carrie Flack, City Development gave complete overview of the ordinances, stating ordinances 970328 and 970329 are companion cases. Ordinance 970328 will rezone property from District R1A to RA. The companion ordinance will rezone property from the RA District to PD/RA which will allow construction of a 131 foot monopole communication tower. The ordinances involves property located at 8700 Leeds Road. City Plan Commission recommends approval subject to certain conditions. Committee recommends approval of the ordinances. Ed Bullard, Attorney, gave several reasons to approve the ordinance. Councilmember Asjes expressed concerns regarding C2 zoning set backs. Committee recommends approval on both ordinances.

Don Gustafson, City Development, gave overview of the ordinance. The purpose of the ordinance will allow construction of a 38 unit motel. The site is currently undeveloped. City Plan Commission recommends approval subject to certain conditions. Dilip Patel, applicant, stated he has met every requirement as requested by the City and City Plan Commission. Councilmember Bacchus expressed concerns about how rare it is to have development to build a 38 unit motel, usually it is anywhere from 60 units and above. Dewayne Worten, Franchise Development Director for Super 8, stated the applicant has applied for a Super 8 franchise, that has been approved. Councilmember Bacchus, expressed concerns about meeting with the residents. Mr. Patel, stated the residents don't think it will be a good motel. Councilmember Bacchus said there are lot of concerns regarding smaller hotels being changed over to uses that are not agreeable with the community. Carol McClure, Co-Chairman, Southern Community Coalition, said have met with applicant before the City Plan Commission hearing and have not heard anything since the revised plans have been made. One of the concerns with area residents is traffic in the location. Area residents and business owners spoke in opposition of the development because of safety issues and traffic concerns. Lewis Schumacher, resident presented the committee with petitions from area residents. He also spoke in opposition of the development and gave reasons why development should not take place. Committee recommends to hold ordinance off the agenda until issues are worked out.

Approving the preliminary plat of Hunt Midwest Tract 2 on a 29.46 acre tract of land generally located on the northeast corner of Highway I-435 and N.E. Parvin Road. (SD 0403A)

Don Gustafson, City Development gave overview of ordinance. The applicant is proposing ten commercial retail lots in three phases. City Plan Commission recommends approval subject to fourteen conditions. David Matthews, 5577 NW Barry Rd., concurs with staff's recommendation. Committee recommends approval of the ordinance.

Dick Smith, Attorney, gave procedural background regarding the TIF's projects. Barry Brady, J.C. Nichols Co., said a development plan has been developed which is to maintain the character of the Plaza. He explained the committee in detailed description of the development. Dick Smith, stated that one of the things that the TIF Commission has looked at carefully is to make sure the project is not being over subsidized, with TIF assistance the return to the Nichols Co. will be 15 - 18%. Project will be completed by the year 2006. Several residents spoke in favor of the plan. Committee recommends approval of the ordinance.
