Patricia Jensen, Assistant City Attorney, stated the communication is legally sufficient or valid and made a recommendation to hold the communication on the agenda for one week.

Approving an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 6.3 acre tract of land generally located on the south side of N.E. Barry Road, approximately 1,200 feet east of N. Troost Avenue, for the purpose of deleting an approximately 0.828 acre tract of land from said preliminary plan. (4460-CP-2)

Ordinances 981414, 981415 and 981416 are companion cases. Carrie Flack, City Development, the ordinances involves property located east of N. Troost Avenue. Ordinance 981414 is a request to amend a CP2 District to delete approximately .8 acres from the plan. Ordinances 981415 and 981416 deals with rezoning property and coming forth with a preliminary plat for the entire area. Art Hammond, Eagle River Investments, stated the development consist of 10 lots which will result in the connection of 82nd Terr. The request follows the recommendation of the FOCUS plan. Councilman Ford expressed concerns regarding traffic devices along 82nd Terr. Mohsin Zaidi, Public Works/Transportation Division, stated there are various ways to slow traffic down. Councilman Ford expressed concerns regarding lot sizes. Carolyn McClure, 1605 NE 82nd Terr. stated a neighborhood committee had done their own research regarding lot sizes, indicating the average lots on 82nd Terrace shows 80 ft, which 65% of the homes on 82nd Terrace have a lot sizes of 75 foot frontage or larger. Also a traffic study was done to try to figure out how to slow down traffic in the area. Eva Art, 1413 NE 82nd Terr, spoke in opposition of the ordinance expressing concerns regarding traffic issues. Jeff Fremtrop, 1213 NE 82nd Terr. spoke in opposition of the project . Amy Sander, 1501 NE 82nd Terr., expressed concerns regarding traffic issues. Committee recommended to hold ordinances on the agenda for one week.

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0185, rezoning an area of approximately 2.2 acres generally located 1,200 feet east of N. Troost Avenue at N.E. 82nd Terrace from Districts CP-2 (Local Planned Business Center and R-1a (One-Family Dwellings) to District R-1a (One-Family Dwellings). (4460-P-3)

RESOLUTION - Approving the Columbus Park Area Plan as a guide for future land use, development and redevelopment of the area generally bounded by the Missouri River on the north, I-35 on the south and east and the Heart of America Bridge approach on the west.

Lynnis Jamison, City Development gave a thorough overview of the resolution stating that there were major revisions done in the agreement for Guinotte Manor. Mike Burke, Attorney, (representing Columbus Park Area), spoke in support of the resolution.
