Authorizing condemnation and taking of private property interests for public use for Permanent Pedestrian Right-of-Way Easement purposes for the construction, location and maintenance of Project No. 89020048, “Route 152 Trail Segment 12,” from Northwest Anglia Street east to Maplewoods Parkway, all in Kansas City, Clay County, Missouri; providing for the payment of just compensation therefore; authorizing continued negotiations and purchase by the Director of the Department of Public Works; authorizing the filing of the petition for condemnation by the City Attorney on behalf of the City; and directing the City Clerk to record this ordinance in the office of the Recorder of Deeds for Clay County, Missouri.


TRANSPORTATION & INFRASTRUCTURE COMMITTEE recommends "ADVANCE AND DO PASS, DEBATE"
Jeff Martin and Kerry Kanatzar from the Public Works, gave a brief overview of this ordinance. The properties being condemned will be used by the City of Kansas City, Missouri for Public Use Access Easements for the purposes of constructing and maintaining the Route 152 Trail. Compensation shall be made by Kansas City from funds appropriated, or to be appropriated, for such purposes. An electronic copy of this presentation can be obtained from the City Clerk's Office.

Amending Chapter 70, Code of Ordinances, by repealing Sections 70-785 and 70-786 relating to pedestrians and enacting in lieu thereof two new sections of like number and subject.


TRANSPORTATION & INFRASTRUCTURE COMMITTEE recommends "DO NOT PASS"
Councilwoman Jolie Justus with dialogue on this ordinance. Legal advice of the constitutional legality pertaining to the enforcement of panhandling. Concerns and solutions for pedestrian and automobile safety are a public concern. KCPD are receiving and responding to calls of aggressive behavior and illegal activities reported but are unable to enforce the incidents that have moved on prior to their arrival. Numerous testimony from the public in favor of, as well as opposition. A recommendation of "Do not pass" has been sent forth to be voted by council.

 1. There may be a general discussion regarding current Transportation and Infrastructure Committee issues.
 
 2. Pursuant to the following subsections of Section 610.021 of the Revised Statutes of Missouri, there may be a closed session to discuss: (1) legal matters, litigation, or privileged communications with attorneys, pursuant to subsection 1; (2) real estate, pursuant to subsection 2; (3) personnel, pursuant to subsection 3 and 13; and/or (4) sealed bids or proposals, pursuant to subsection 12.
 
 The City Clerk`s Office now has equipment for the hearing impaired for use with every meeting. To check out the equipment please see the secretary for each committee. Be prepared to leave your Driver`s License or State issued Identification Card with the secretary and she will give you the equipment. Upon returning the equipment your license will be returned.
