Approving and designating Project 8 (Kirkwood) of the Country Club Plaza Tax Increment Financing Plan as a Redevelopment Project and adopting tax increment financing therein.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "HOLD ON AGENDA"
Ordinances 970382 and 020726 are related cases. Councilman Ford stated he received a letter from Charles Miller requesting the ordinance be held. Vince Dasta, President, DST Realty, 333 W. 11th Street, stated because of the timing of the project he doesn't feel that the issues relating to the project were pertinent enough to hold the ordinance for one week. John Eckardt, City Planning & Development Department, stated the proposed site plan calls for a maximum of 240 units within 16 structures. The building will be all residential, for sale units ranging in height from 12 stories to 3 stories. A private open space park is proposed for the center of the site and extends from Central to Wyandotte. The net density of the site will be about 30 units per acres. The required parking for the project is 240 spaces - 1 space per unit. The proposed parking spaces provided are 556 spaces. Of the 556 spaces, 521 will be garaged and 35 will be on surfaced lots. The project will be completed in one phase. The developer of the project is Kirkwood Realty, LLC. Although the initial submittal called for 240 maximum units, the applicant has also submitted a plan calling for 203 units. City Development staff has agreed to only review the 240 unit plan and allow for the reduction of units as allowed for in the site plan. There were some concerns in opposition regarding the access on upper Wornall with a new pedestrian way.

PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "DO PASS"
Ordinances 020784 and 020786 are related cases. Kelli Cochran, Economic Development Corporation, stated the ordinances are related to the Chouteau I-35 TIF Plan which provides for approval of the first amendment to the plan and project areas 3 & 4. The redevelopment area is located at the intersection of I-35 & Chouteau Trafficway in Clay County. The TIF Commission approved the first amendment and project area 3 on June 10, 2002. Staff is requesting that project area 4 (020786) be held off the agenda until the developer is ready to proceed with the project. She also gave a thorough overview of what the amendment entails. The TIF Commission has found that the first amendment is consistent with the original plan and will provide for the remediation of flooding and infrastructure problems and also allows for upgrades to roads in the area. Councilman Ford stated that the TIF Commission asked the developer to look at the west side of Chouteau regarding the fast food restaurant to alleviate blight on that side of the street. Cochran, stated that with approval of the original plan TIF staff asked the developer to focus on development on the west side of Chouteau. Originally development was focused on the east side. Councilman Ford added ordinance 020758 to this portion of the hearing which is the rezoning ordinance. A committee substitute was submitted for ordinance 020758 which deals with the issues of the sidewalks. Patty Noll, City Planning & Development Department, gave testimony on the ordinance. The proposal is to rezone the property from District R-1b, CP-1 and CP-2 to Urban Redevelopment District (URD). The first phase will permit construction of McDonald's Restaurant. Phase II will remove the existing office building and construct a building to accommodate retail, hotel and office uses. The southern portion of the lot will remain undeveloped. The developer has received approval from the Army Corps of Engineer to realign the creek and to alleviate the flooding problems. The Committee substitute removes the condition within the ordinance which instructs the developer to improve NE 43rd Terrace. Staff has agreed that there would be no impact to the street due to the limited income from the project. Councilwoman Cooper expressed concerns regarding improvements on the west side of Chouteau. Area business owners spoke in opposition of the rezoning.

PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Larry Stice, City Planning & Development Department, stated the ordinance vacates the alley between Grand & McGee from 9th Street to 10th Sreet. The applicant is the Federal Reserve Bank. The purpose of the vacation is to allow the (Federal Reserve Bank) to gate the alley on a permanent basis for security purposes. The adjacent property owner (Grand Avenue Methodist Church) had concerns that their parishioners would have have access to their building due to the date. Committee recommended approval.

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0426, rezoning an area of approximately 10.69 acres generally bounded by 49th Street on the north, 50th Street on the south, Wornall Road on the west, and approximately 140 feet east of Wyandotte Street on the east, from Districts PD/R-6 (Planned District/High Apartments) and R-2a (Two-Family Dwellings) to District URD (Urban Redevelopment District), and approving a development plan for the same. Dion Waldon, Public Works Department, stated the plat is located along Blue Ridge, west of 350 Highway & Valley Garden Drive. The plat is for 41 single family residential lots. The plat authorizes acceptance of various easements and establishing grades. The developer has complied with all the requirements. Mike Burke, King, Hershey Law Firm, Attorney, concurred with staff's recommendation.

Kelli Cochran, Economic Development Corporation, stated the ordinances are related to the Chouteau I-35 TIF Plan which provides for approval of the first amendment to the plan and project areas 3 & 4. The redevelopment area is located at the intersection of I-35 & Chouteau Trafficway in Clay County. The TIF Commission approved the first amendment and project area 3 on June 10, 2002. Staff is requesting that project area 4 (020786) be held off the agenda until the developer is ready to proceed with the project. She also gave a thorough overview of what the amendment entails. The TIF Commission has found that the first amendment is consistent with the original plan and will provide for the remediation of flooding and infrastructure problems and also allows for upgrades to roads in the area. Councilman Ford stated that the TIF Commission asked the developer to look at the west side of Chouteau regarding the fast food restaurant to alleviate blight on that side of the street. Cochran, stated that with approval of the original plan TIF staff asked the developer to focus on development on the west side of Chouteau. Originally development was focused on the east side. Councilman Ford added ordinance 020758 to this portion of the hearing which is the rezoning ordinance. A committee substitute was submitted for ordinance 020758 which deals with the issues of the sidewalks. Patty Noll, City Planning & Development Department, gave testimony on the ordinance. The proposal is to rezone the property from District R-1b, CP-1 and CP-2 to Urban Redevelopment District (URD). The first phase will permit construction of McDonald's Restaurant. Phase II will remove the existing office building and construct a building to accommodate retail, hotel and office uses. The southern portion of the lot will remain undeveloped. The developer has received approval from the Army Corps of Engineer to realign the creek and to alleviate the flooding problems. The Committee substitute removes the condition within the ordinance which instructs the developer to improve NE 43rd Terrace. Staff has agreed that there would be no impact to the street due to the limited income from the project. Councilwoman Cooper expressed concerns regarding improvements on the west side of Chouteau. Area business owners spoke in opposition of the rezoning.
