Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0516, rezoning an area of approximately 58 acres generally located south of Missouri Route 152 (Barry Road), between N.E. Flintlock Road on the west and N. Church Road on the east from Districts C-2-p (Local Retail Business - Limited District) and MPC (Master Planned Community) to C-2-p (Local Retail Business - Limited District), and approving a preliminary plan for the same. (9815-P-44)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
John Eckhart, City Development, stated the 58 acre tract of land in this ordinance will include a Walmart, Mc Donalds, Applebees and Holiday Inn. The changes to the site are due to a change in the alinement of North Flintlock Rd., and three lots that have never been developed which will be reconfigure to allow for the changes in the road. It will only affect about 2.5 acres of land. There will be changes to the private drive entrance and walkways of this project to improve foot traffic and access to the shoppes in the project. All the conditions set by City Development are agreed up on by the City and the developer. David Matthews, John Lutjen and Associates answered a question from Councilman Fairfield regarding the responsibilities of the City for maintenance of the sidewalks and access roads for the project. David Matthews stated, condition with in the ordinance outlined the responsibilities and the developer had agreed to be the primary responsible for maintence.

Approving an amendment to a previously approved development plan in District M-1-p (Light Industry - Limited District) on approximately a 50 acre tract of land generally located east of the Missouri/Kansas state line, on the east and west sides of Missouri Highway 150, and northwest of the Northwesterly Missouri-Pacific Railroad Company Railroad right of way. PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Patricia Noll, explained that the ordinance was in the far south end of the city and intersects with State Line. The usage will be light industrial storage space for the company Storage Mart which will store recreational vehicles and a food and beverage distribution warehouse. She further explained that a portion of the property is in the 100 year flood plane and the developer will need to get a cerificate from FEMA. The developer, testified about his family business and it's history and his excitement at having three storage businesses in the area.

Approving the preliminary plat of The Reserves on approximately a 5.9 acre tract of land generally located on both sides of N. Flora Avenue, extended north of Missouri Route 152. (SD 1058)

Peter Schlesinger , City Planning, testified that the Parkway adjacent to the project recently opened and will greatly improve access. Both items 031066 and 031067 deal with the project known as The Reserves. There is a rezoning and five single family that are larger than homes in the surrounding area Dion Waldon had concerns about water run off in the area of the project due to the high elevation. Dion Waldon explained that the concerns regarding drainage will be address by special inspection that will determine whether there would be a need to make adjustments during construction. David Pavilich representative of the owner/developer stated that they tried hard to leave the property in it's natural state. The wooded area and high elevation are aspects that add charm to the project.

PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Tim Parks, City Development, addressed the rezoning of a project near Searcy Creek Parkway to allow multi-family units and the Tri-County Training Center for the mentally ill. Steve Walcot, stated that he believe that the R-5 zoning would be the most appropriate for the project. Councilman Fairfield asked about the water run off of the project. Tim Parks, explained that the issue of storm water run off had already been addressed. Tim Parks stated that there had been no opponents to the project.

PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS AS A COMMITTEE SUBSTITUTE"
Peter Schlesinger, City Planning, testified regarding the project and how it is divided by the State Line. This has bought up some unique issue both staff and the developer have meet the challenge. The project consist of a convenience store, car wash and gas pumps. The Committee expressed concerns regarding the traffic flow entering the project. There are several car dealerships and other high traffic businesses that would be impeded with the additional traffic to the gas station. He stated that tthe entrance is not in the City of Kansas Cities jurisdiction but the proposed entrance is in Gladstone and would make for better flow. Kathleen Gorman the Architec for the project stated that the project being divided by two cities had proven to be a challenge. She asked that the committee agree to a list of condiction so that the project could be permitted through the City of Gladstone. There was discussion of the conditions list and the error regarding the district listed in the ordinance. There was a committee substitute to correct the error.

Approving a General Development Plan for the 41st & Paseo Redevelopment Planning Area for an area of approximately 7.15 acres generally bounded by E. 41st Street, The Paseo, Wayne Avenue, and E. 42nd Street, declaring the area included in such plan to be a blighted area, insanitary or undeveloped industrial area and its redevelopment necessary and approving the ad valorem tax benefits.

Approving the plat of Staley Farms-Sixth Plat, an addition in Kansas City, Clay County, Missouri; accepting various easements; and establishing grades on public ways.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Dion Waldon, Public Works, explained that this ordinance would approve the 6th plat for a development known as Staley Farms it would allow 32 additional single family residences. He stated that the concerns including maintenance of storm water drains have been resolved. Jim Bowers of White Goss and Associates and staff recommend do pass. He further explained the storm water drainage and would be the primary responsibility of the developer. Jim Bowers stated that this project had been approved since 1985. The project includes residential and commercial units and the project is on target and doing well with the sale of proposed units.
 
 There will be a closed session to discuss a Real Estate Transaction pursuant to RSMo. 610.021 (2).
