Amending Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 80-11A0033, rezoning an area of approximately 0.5 acres generally located at 9301 Blue Ridge Boulevard from District R-1a (One-Family Dwellings) to District C-2-p (Local Retail Business - Limited District), and approving a preliminary plan for the same. (8110-P-2)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "HOLD ON AGENDA"
Carrie Flack, City Development gave a overview of the ordinance. The ordinance will rezone about half an acre located at 93rd & Blue Ridge Blvd. The rezoning request is in compliance with the approved area plan. The site plan is to construct a custom muffler/brake shop on a triangular shape parcel of property. The Blue Ridge Corridor plan recommends a consistency in architectural style throughout development in the area. City Plan Commission recommends approval subject to certain conditions. Allen Otto, applicant, concurs with staff's recommendations. Carol McClure, Co-Chairman Southern Community Coalition. In October 1990, the Blue Ridge Corridor plan was approved. Within the plan it states that service entries should not face a main arterial road, the plan should be followed. She urged the committee not to approve the project at this time. They're not opposing the muffler shop but feels that the entrance on Blue Ridge does not fit with the plan. Committee recommends to hold for one week.

Approving the assignment of certain development rights with respect to Phase 2 by Brush Creek Redevelopment Corporation to Jefferson At The Plaza Redevelopment Corporation; releasing Brush Creek Redevelopment Corporation as it relates to those certain development rights; approving the third amendment to the development plan submitted by Jefferson At The Plaza Redevelopment Corporation; authorizing the Director of Finance to enter into a Third Supplemental Contract with Jefferson At The Plaza Redevelopment Corporation; and recognizing the eminent domain rights previously granted.

John Eckert, City Development, updated the committee thoroughly regarding the amendments for the project. Ordinance 970327 and 970209 are companion cases. The ordinances deals with an amendment to an existing "353" and URD plan for the Brush Creek project. The location of the plan was shown on overhead projector. A traffic study was done on the project. The Redevelopment Coordinating Committee recommended ten year of 100% tax abatement which is 3.8 million dollars. City Plan Commission and Redevelopment Coordinating Committee recommends approval. Committee recommends approval on both ordinances.

John Eckert, City Development stated the ordinance was held for the last two week to work out an agreement. Aaron March, Polsinelli & White, representing the applicant. In the past two weeks, important things have occurred: 1) to look at the east side of the project to see if the "covered spaced" could be reduced and increase the "green space". A site plan has been submitted to City Development Department which eliminate four surfaced parking spaces; 2) met with residents to show them the revised plan and architectural guidelines for the site The residents of the "Walnuts" now supports the project. John Eckert showed the committee the project changes. Jerry Riffle, Lathrop & Gage Law Firm, spoke on behalf of the Walnut Association, the reduction of the improvements to lessen 75% of the land area, is a significant improvement. An agreement for traffic improvement have been reached relating to the Kirkwood Circle. Councilmember Bacchus expressed concerns regarding the 20 feet set-back on east side. Aaron March, said the set-back of the building did not change, the parking has been deleted. There are 51 units in the project. Committee recommends approval of the ordinances.

Patty Noll, City Development, the ordinance is for Project III of the Uptown Theater Tax Increment Financing plan. The purpose of the project was to assist in demolition of an apartment building. Ordinance 970088 is for Project V located at 3800 Broadway to assist with construction of a 2000 square foot building and to house a check cashing operation with three apartment units above. Pat Sterrett, Economic Development Corporation, stated The amount of TIF revenue to be secured is $164,0000, to be used for debt coverage on the bonds which has not yet been issued. Larry Sells, stated the new check cashing building has been approved for a building permit. Construction should begin within 30 to 40 days. Councilmember Asjes expressed concerns regarding TIF's payments.
