Vacating a portion of N.E. Barnes Road generally located east of I-35 to allow for a lot combination and directing the City Clerk to record certain documents. (CD-ROW-2019-00017)


NEIGHBORHOOD PLANNING AND DEVELOPMENT COMMITTEE recommends "DO PASS"
This ordinance will vacate a portion of N.E. Barnes Road, located east of I-35 to allow for a lot combination. Zach Nelson, City Planning, provided a presentation to this ordinance. The area to be vacated is located along NE Barnes Rd and is currently unpaved. The section of road in this area ends in a stub street and is undeveloped. There is an existing church to the south and undeveloped land to the north, also owned by the church. The applicant represents the church to the south and is requesting to vacate the subject site in order to combine the properties to the north and south. City Plan Commission recommended approval of this vacation, subject to two conditions. The first condition is to retain a utility easement and protect all Spire facilities. The second condition is the applicant shall maintain Fire Department access to the public fire hydrant located on the remaining distal end of NE Barnes Rd. Approving a Council approved signage plan pursuant to Chapter 88-445-11, in District R-2.5 on about 50 acres, generally located at the northeast corner of N.W. 68th Street/N.W. Waukomis Drive and N. Line Creek Parkway, to allow for a new school digital signage pursuant to Section 88-445-11-E. (CD-CPC-2019-00181)


NEIGHBORHOOD PLANNING AND DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS, DEBATE"
This ordinance will approve a Council approved signage plan pursuant to Chapter 88-445-11, in District R-2.5 on about 50 acres, located at the northeast corner of N.W. 68th Street/N.W. Waukomis Drive and N. Line Creek Parkway, to allow for a new school digital signage pursuant to Section 88-445-11-E. Olufu Agbaji, City Planning, provided a presentation to this ordinance. The Park Hill School District is requesting approval of a Council Approved Signage Plan to allow for a new school digital signage plus any necessary variances. The applicant is proposing a secondary digital sign in addition to the approved monument sign. The sign is proposed to be located along the private drive approximately 300 ft from N. Line Creek Parkway. The sign is 5.5 feet tall and 8 feet wide and will be placed on a concrete monument base. The digital portion of the sign is 2.5 feet X 7.1 feet, which comes to about 15 sq. ft. The applicant states that the sign will be used for messaging for parents and visitors only. They fell that with the sign located 300 ft away from the public road making it appear less than ¼ inch tall and rendering it illegible and considerably not visible from the right-of-way per the intent of the code. Trees, undergrowth and distance shield the sign from other surrounding properties with the closest property line being located 150 inches to the north. RESOLUTION - Approving an amendment to the Country Club/Waldo Area Plan on about 0.9 acres generally located southwest of the intersection of Ward Parkway and W. 79th Street by changing the future land use from commercial with Pedestrian Oriented Design focus to residential low.


NEIGHBORHOOD PLANNING AND DEVELOPMENT COMMITTEE recommends "DO NOT PASS AS ADOPTED"
Approving an amendment to the Country Club/Waldo Area Plan on about 0.9 acres generally located southwest of the intersection of Ward Parkway and W. 79th Street by changing the future land use from commercial with Pedestrian Oriented Design focus to residential low. Mayor Pro Tem, Kevin McManus, 6th District, spoke to this ordinance. This will re-zone the area back to the original zoning. Mayor Pro Tem stated that they wanted to speak to the new owners, the neighborhood and to see if there could be restrictions added to that rezoning. They are currently working on a restricted covenant to restrict the land to certain uses. Mayor Pro Tem recommended that the committee should vote to advance this resolution, and its related ordinance (200124), to fail as they are no longer needed.

NEIGHBORHOOD PLANNING AND DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO NOT PASS, DEBATE"
Rezoning an area of about 1.68 acres generally located southwest of the intersection of Ward Parkway and W. 79th Street from District B1-1 to Districts B1-1 and R-6, and repealing a development plan authorizing the McGonigle’s Expansion Plan. . Mayor Pro Tem, Kevin McManus, 6th District, spoke to this ordinance. This will re-zone the area back to the original zoning.
