John Eckert, City Development gave a in-depth overview of the ordinance. He stated ordinances 961592 and 961593 are companion cases. Ordinance 961592 is a preliminary plat for Pembrook Estates for 48 acres of land, located at N. Indiana. The companion ordinances rezones the area. The project is scheduled to be completed by the year 2004. The project will be completed in six phases. Phase six will not be completed until the roadway to the proposed Essex Ridge apartment complex is completed. The parkland dedication fee is in the amount of $26,229.57. Committee recommends approval of both ordinances.

Carrie Flack, City Development, stated ordinances 961594 and 961594 are companion cases. Ordinance 961595 will rezone 24.4 acres. The companion ordinance is for a Community Unit Project plan is for 144 single family dwelling on 18 lots. The project will developed in a number of phases. The applicant is proposing to cluster the single family residences around a private cul-de-sac because of the models of the clusters, certain front/back yard variances are necessary. The cul-de-sac will be considered as a private courtyard. John Roe, Attorney, concurs with staff's recommendation. Photograph's of the site were shown to the committee. The cost of the homes is anticipated to be $150,000 each. The project will be constructed in two phases. Councilmember Bacchus asked if the streets were private. Committee recommends approval of both ordinances.

Larry Stice, City Development stated gave an overview of the ordinance. City Plan Commission recommends approval subject to certain conditions. David Matthews, John Lutjen & Associates, stated the first plat is underway and concurs with staff's recommendations. Councilmember Glover expressed concerns regarding the square footage and value of the homes. Committee recommends approval of the ordinance.

Authorizing the Director of City Development to enter into a First Supplement to the Amended and Restated Cooperative Agreement for the Project Financing with the Land Clearance for Redevelopment Authority of Kansas City, Missouri, the Tax Increment Financing Commission of Kansas City, Missouri, and the 13th and Wyandotte Hotel, L.L.C.; and directing the City Clerk to file such First Supplement.

Bob Langenkamp, City Development, stated the ordinance is related to the renovation of the Americana Hotel. The cooperative agreement is between the City, Land Clearance Redevelopment Authority, Tax Increment Finance Commission and the Developer. The only change in the cooperative agreement is an extension of the completion date. Initially the completion date was set for November 15th, which has been extended to April 15 '97. The change has been approved by the TIF Commission. Councilmember Bacchus asked why was the completion date changed. Bernard Craig, representing Americana Hotel stated, because of the financing being renegotiated. Once financing was in place it was about an eight months development period. Bob Collins, Assistant City Manager, stated the time it took to renegotiate the financing and the issuance of bonds and to get council's approve the process took about three to four weeks. Committee recommends approval of the ordinance.

Carrie Flack, City Development stated the ordinance has been held in committee for several weeks to allow the applicant to work with Public Works Departments, regarding improvements. Councilmember Bacchus stated for the record there were certain conditions that need to be resolved. Lee Dixson, Public Works Department stated he has had several telephone conferences with the Missouri Highway Department to discuss safety issues in the area. The Highway Department is in favor of putting in a 12 foot lane. There's a proposed driveway to be installed adjacent to the development. The highway department believes that with the speed limit being 55 mph and the amount of traffic, there would need to be a turning lane which consist of 100 ft of 12 ft pavement including an deceleration lane to be about 660 feet long. The concept is that people will be going at 55 mph would need to get out of the lane as quickly as possible. Mike Burke Attorney, stated the developers are in agreement with certain conditions. There is a safety issue involved. The developer will execute two 100 ft right-hand turning lanes at NE 108th Street and one lane turning into the proposed development site and will also contribute 1/3 of the additional cost of putting in a turning land which may be needed from 108th Street. He also pointed out that highway 291 is not a highly travel roadway. Counciilmember Asjes asked what the cost would be for the additional lanes. It was the consensus of the committee to hold the ordinance for one week.
