Amending Chapter 88, the Zoning & Development Code, by repealing Section 88-610-03., Nonconforming Lots, and enacting a new section of like number and title in lieu thereof; deleting Section 88-820-01-B., Exceptions; and enacting Section 88-110-06-D., Exceptions, to permit construction of a single family-dwelling on an area of land legally created. NPD AND SPECIAL COMMITTEE ON HOUSING POLICY recommends "DO PASS AS A COMMITTEE SUBSTITUTE"
This ordinance will amend Chapter 88, the Zoning & Development Code, by repealing Section 88-610-03., Nonconforming Lots, and enacting a new section of like number and title in lieu thereof; deleting Section 88-820-01-B., Exceptions; and enacting Section 88-110-06-D., Exceptions, to permit construction of a single family-dwelling on an area of land legally created. Joseph Rexwinkle, City Planning, provided a presentation to this ordinance. The purpose of this ordinance is to clarify that a single-family dwelling may be erected on any area of land in separate ownership subject to certain provisions. This ordinance does not adjust the Code’s level of density for any zoning district or the minimum parking requirements. By code, a side yard is on the same lot as the home; however some homeowners have bought an adjacent lot beside their home and some might consider this to be a side yard. The ordinance would only allow this lot to be sold and developed if it was legally created (i.e. if it was platted). Lot combinations would continue to be allowed as they are today.
