RESOLUTION - Approving an amendment to the Longview Area Plan, being that part of Kansas City bounded by 87th Street on the north, the corporate limits of Kansas City on the south and east and Blue Ridge Boulevard on the west, by modifying the Land Use Plan and Map for an area of approximately 4 acres generally located at 13901 East U.S. 350 Highway, to recommend "retail commercial uses" instead of "agricultural and low density residential uses". Michaela Hunter, City Development Department, the resolution is a companion to ordinance 001265. The resolution involves four acres located on the south side of 350 Highway. The resolution is also the Land Use Plan for the Longview Area plan which was approved in 1979. The property has been used for commercial uses. In 1988 the property was rezoned to District C-2p. At the time of the rezoning the corresponding area plan was not amended to reflect the rezoning. The proposed area plan is to amended the area plan to identify the site as retail commercial. Ordinance 001265 is to amend a previously approved development plan in district C-2p. the property was originally used for an auto and trailer sales facility prior to annexation. When the property was annexed a Certificate of Legal Nonconforming Use was issued. The property owner subsequently expanded an existing building and constructed a third building without obtaining a building permit. The property was sold to the current owner, who also constructed a fourth building without a building permit. The owner was cited by the Codes Administrator for not obtaining permits and for being in violation of the zoning ordinance. A case is pending before Municipal Court for failure to obtain a building permit. The judge has ordered the applicant to resolve the zoning issues and obtain the necessary building permits, or face a jail sentence. She stated that staff was very hesitant in recommending approval for the project. The applicant was to remove signs and setback a fence back and install landscaping prior to the hearing. Councilman Ford recommended that the ordinance be held for one week to allow the applicant to clean up the area. He also stated if it's not clean by next week the ordinances will be held off the agenda.

The purpose of the text amendment is to clarify the language to specifically prohibit digital display signs to identify any use permitted in section 80-41(3)(a) to include: churches and synagogues, public and private schools, community center buildings. police stations, public libraries and museums and art galleries.

She stated the second amendment is for the addition of the Plaza East project as a project within the Brush Creek Corridor TIF Plan. The proposal calls for construction of commercial uses, with all necessary utilities, street improvements bounded by Troost Avenue, Brush Creek, Paseo and 47th Street. Ollie Gates, applicant, spoke in support of the project concurs with the recommendations.

Laura Whitener, Economic Development Corporation, gave a brief overview of the ordinance. She stated phase I is one of four phases of the project. Phase I provides for the deposition into the TIF special allocation fund 100% of the PILOTS (payment in lieu of taxes) and 50% of the economic activity taxes generated by the first phase of the project. These revenues will be used to reimburse costs to construction related to a port of 48th Street and other eligible projects under the Brush Creek Corridor plan. Ollie Gates, applicant spoke in support of the project concurs with the recommendations.

The specific contract is for completion of the landscaping services designed complete specifications for phases II and III. The contract will also allow Oschnser, Hare and Hare to continue the inspection services for quality control of bridges. The roadway is expected to be completed by the year 2001.
