Terminating a Cooperative Agreement for Public Improvement with Baptist Medical Center.

Stan Harris, Public Works Engineering, reported that Baptist Medical Center had requested the agreement be terminated. Improvements have been completed and by terminating the agreement the title becomes clear.

Authorizing twelve STP-Urban Agreements with the Missouri Highways and Transportation Commission relating to upgrading existing signals at various locations throughout the City.

Stan Harris, Public Works Engineering, stated this ordinance allows the city to enter into agreements with the Missouri Highways and Transportation Department for work on traffic signals throughout the city. The ordinance allows the city to accept federal funds associated with the agreements.

Jim Mellem, Deputy Director - Water Services, said this ordinance was approving sewer rehabilitation work for the Craig Road Sewer Rehabilitation Project. The bid amount for services was understated and had to be adjusted.

Authorizing two agreements with the Missouri Highways and Transportation Commission relating to construction of improvements to westbound I-470 from Blue Ridge Boulevard Interchange to Grandview Road Bridge over westbound I-435 and eastbound I-470 from Manchester to Blue Ridge Boulevard Interchange and directing the City Clerk to file certain documents with the appropriate offices.

Stan Harris, Public Works Engineering, stated that this ordinance would give permission for use of the city's right of way to the State to make improvements to I-470 and I-435 Interchanges. There is no cost connected to the ordinance.

Authorizing an agreement with the United States of America, through its Corps of Engineers, for the purpose of acquiring lands, easements and right-of-way to construct a flood control levee in the Dodson Industrial District and authorizing the Director of Public Works to expend $65,000.00 as the City share of the cost for the improvement.

Stan Harris, Public Works Engineering, stated that this ordinance was to approve the city's portion of funding necessary to receive federal funds for the purpose of purchasing land for a flood control levee. The city would be working with the Property Acquisition Group to purchase land in the Dodson Industrial District for the Dodson Flood Control project.

Reducing an appropriation in the amount of $3,400,000.00 in the Local Use Tax Fund; appropriating it and transferring it from the Local Use Tax Fund to the N. Agnes Avenue Bridge account of the Capital Improvement Fund; designating requisitioning authority; and declaring the City intent to reimburse itself with funds designated for the North Agnes Bridge in fiscal years 2004, 2005 and 2006.

Stan Harris, Public Works Engineering, stated the ordinance was to pay for a bridge and roadway improvements to the N. Agnes Avenue Bridge. The roadway had to be raised because the area affected was located in a floodplain area. Work should be completed by the end of the year.

Giving permission to Tower Properties Company to construct and maintain landscape planters in the public right-of-way for the building at 811 Main Street.


OPERATIONS COMMITTEE recommends "ADVANCE AND DO PASS AS A COMMITTEE SUBSTITUTE"
This ordinance would approve funding for beautification to area surrounding the property at 811 Main Street. The project extends to 9th and Walnut. According to Rick Usher, Codes Administration, work is already under way for improvements to the area. Jim Bauer spoke in behalf of the project. He stated that the improvements (current and proposed) are consistent with the downtown plan. He also asked that the encroachment fee be waived since none of the fees would be recaptured by the company. Resolution No. 020425 provided for spending of money for aesthetic purposes. Councilman Paul Danaher wanted to know how much would be spent for beautification. Mr. Bauer said the total would be approximately $220,000.00 which included the amount of the fee of $18,450.00.
