Ordinances 001344, 001345, 001346, 001347 and 001348 are related cases. Councilman Ford, gave background history on the project. He stated that the project was originally recommended by staff and City Plan commission. Ms. Ragan (applicant) took the city to court in Clay County to have a judge review whether the City Council was within it's powers to turn down the zoning. After a full hearsing the city received a judgement from Judge Russell, which found that the city unreasonably refuse to rezone the property and ordered the city to do so. Virginia Walsh, City Development Department, stated that the project is for a three sites. The rezone considers approval of a community unit project to allow for 26 duplex units, a tri plex unit and 44 four units. Staff and City Plan Commission recommended approval with certain conditions. Mark Epstein, Attorney, spoke in support of the ordinances and request that the committee approve the ordinances. Shirley Smith, 4618 N. Bennington, spoke in opposition of the project because of the street and road density. Marsa Robinson, 7316 NE 46th St. President of Randolph Corners and Winchester Woods neighborhood. She stated she is in disagreement with the judges recommendation. She explained how Bennington Road is so narrow and dangerous. Committee recommended approval of the ordinances.

Authorizing the City Manager to execute a tax credit agreement with the Missouri Development Finance Board and the Kansas City Public Television Channel 19 for the issuance of tax credits and the acceptance of private contributions for the KCPT Channel 19 construction and improvement project located at 125 East 31st Street, Kansas City, Missouri.

Gabriel Okafor, City Development, stated that approval of the ordinance will authorize a tax credit agreement with Missouri Development Finance Board (MDFB) and Kansas City Public Television 19 and the acceptance of private contributions for KCPT Channel 19 construction and improvement project. Earlier this year the council approved ordinance 000441 authorizing an application for the issuance of state tax credits not to exceed $2,000,000 in support of a fund raising effort by the KCPT, MDFB approved the application and granted tax credits in the amount of $1,000,000.00.

Authorizing execution of a $5,000.00 Cooperative Agreement with the Economic Development Corporation for the purpose of completing a Bannister/Three Trails Community Improvement District for the area generally bounded by 87th Street on the north, Bannister Road on the south, I-435 on the west and Hillcrest Road on the east; and directing the City Clerk to file certain documents with the appropriate offices.

The Bannister area merchants have contributed $5,000 to leverage the additional %5,000. the Bannister/Three Trails Community Improvement District, once established intends to reimburse the city of $5,000.00.

Lee Dixson, stated that there are some deferral agreements for developments that's located along Northwood Road that would be triggered by development that will take place in the area. Committee recommended to hold ordinances 001152 and 001153 until November 29, 2000.
