Approving an amendment to a previously approved preliminary plan in District C-2-p (Local Retail Business - Limited District) on approximately a 21 acre tract of land generally located at the northeast corner of Interstate I-435 and State Line Road. (7825-P-13)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Don Gustafson, City Development stated that the ordinance is a request to amend the existing development plan located at I-435 and State Line Road. The plan includes three buildings. which will consist of five thousand square foot addition to the existing twenty one thousand square feet building. The entire area plan includes 2 other dealerships. City Plan Commission recommended approval with certain conditions. Committee recommended approval of the ordinance.

RESOLUTION - Amending the Downtown Industrial Area Plan by amending the Proposed Land Use Plan and Map for an area generally located on the east side of Walnut Street and on both sides of 16th Street by changing the recommended land uses from "light industry" to "mixed uses".


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "IMMEDIATE ADOPTION"
John Eckardt, City Development stated that resolution 991627 and ordinance 991628 are companion cases. Resolution 991627 will amend the Downtown Industrial area plan by changing the proposed land use from light industry to mixed uses. The proposal for the area is to change the land use from two light industrial buildings to allow residential uses. Ordinance 991628 will grant a "353" tax abatement stated for the entire area which is about 1 acre. The Redevelopment Coordinating Committee (RCC) and City Plan Commission (CPC) encourages the developer to remove the surface parking lot which at one time was a part of the "353" plan. The redevelopment project consists of two building: Emery Bird Thayer building which is a six story building located at 1601 Walnut. This building is proposed for 102 residential apartment units, work out area and office space; Campbell Paint building located at 1521 Walnut, to be proposed for 58 residential apartment units w/parking. The area is declared blighted. The project is to be completed by December 2000, costing approximately 16 million dollars. The City Plan Commission and the Redevelopment Coordinating Committee recommended approval of the project with certain conditions. Dale Shulte, Polsinelli & White, attorney/applicant concurs with staff's recommendation.

Edgar Jordan, City Planning & Development Department stated that the ordinance is associated with the sale of Western Auto to a company named Atlantic Pearl which will authorize the consent, attorment and estoppel certificate for the city to sign, so that the license agreement which the city currently has with Western Auto be transferred to Atlantic Pearl. Committee recommended approval.

Larry Stice, City Development stated the ordinance will vacate a portion of N.E. 98th Street. He also gave a thorough overview of the ordinance to the committee. Committee recommended approval of the ordinance.

Reestimating and appropriating revenue in the amount of $3,600.00 to the Property and Relocation Services account of the General Fund and authorizing execution of a Relocation Services Agreement with the Housing and Economic Development Financial Corporation for relocation services provided for the Brooklyn Infill II Project by the City.

Gabriel Okofor, City Planning and Development stated that an ordinance was approved in 1997 which authorized staff to enter into a purchase contract with the Housing Authority. The contract allowed the city to purchase the Heritage House Apartments. Approval of the ordinance will authorize staff to pay $136,000.00 from funds previously appropriated in the Infrastructure and Maintenance Fund for the reimbursement to the Housing Authority for expenses incurred in connection with the relocation of Heritage House tenants. Committee recommended approval of the ordinance.

Approving the plat of Oakwood Forest 3rd Plat, an addition in Kansas City, Platte County, Missouri; accepting various easements; establishing grades on public ways; accepting certain lands for park purposes forever, in accordance with Section 58 of Article III of the Charter of Kansas City.

Lee Dixson, Public Works Department stated that the ordinance is for a thirty one lot residential development located on the east side of N. Brighton. The developer was required to submit a storm drainage study for improvements for to N. Brighton to obtain a land disturbance permit. All of the grades and closures have been checked and he recommended approval. Mike Burke, Attorney, concurs with staff's recommendations.

Irvin Blue, Housing Community & Development Department stated that a report was completed in June of 1998. He gave thorough update to the committee. Committee recommended approval of the ordinance. Councilman Nash spoke in supported the ordinance of how good this work will be for the neighborhood. Doug Hinsman, 1627 Main, spoke in support of the ordinance.

Patricia Jensen, Assistant City Attorney, explained the changes in the ordinance saying the changes deal with the definition section of the zoning ordinance 80-20 specifically three definitions: (1) Banks saving & Loans Associations or other financial institutions; (2) check cashing establishments. A second committee substitute was submitted on the ordinance. The ordinance will restrict the zoning designation for Pay Day loans, check cashing facilities. Councilman Simmons testified in support of the ordinance. He stated that there are concerns of the neighborhoods regarding check cashing facilities being in residential areas, because there has been a growning number of these establishments over the years. He also stated that the ordinance is not to put check cashing facilities out of business but only to indicate that there are too many in the neighborhood. He went on to say the ordinance should be looked at carefully to seek other alternatives. Councilman Ford asked the Assistant City Attorney what kind of businesses were permitted in C3a1. Patricia Jensen answered Mr. Ford's question.
