Approving an amendment to a previously approved preliminary plan in District CP-1 (Neighborhood Planned Business Center) on approximately a 11.69 acre tract of land generally located at the southwest corner of N.W. Barry Road and N. St. Clair Avenue. (5905-CP-39)

Approving an amendment to a previously approved Community Unit Project on an approximately 103.5 acre tract of land generally located at the northeast corner of N. Brighton Avenue and N.E. Pleasant Valley Road. (8793-CUP-4)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Travis Kiefer, City Planning, explained that the ordinance would allow the construction of 27 single family lots and release various easements and grades. It would also make allowance for the maintaining of storm water drain. Dan Weissbury, Representative for the Developer, expressed the excitement of the developer and being able to proceed with the project.

Approving an amendment to a previously approved preliminary plan in District M-1-p (Light Industry - Limited District) on approximately a 3.5 acre tract of land generally located at 1504 N.W. Vivion Road. (12848-P-1)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Tim Park, City Developer, stated that the parcel being zoned for light industry was currently undeveloped. The ordinance before the committee would allow a structure that would house 28,000.00 square feet office building. Councilwoman Cooper asked for more details concerning the construction and regulation for signs. In particular a Billboard vs Pylon. Staff recommended only one sign for the project ( a larger billboard). Councilwoman McFadden-Weaver commented about the over use of signs. Stating that it is common practice to use multiple signs to market businesses. Councilman Fairfield expressed reservations about making changes to the ordinance at this juncture.

Approving an amendment to a previously approved development plan in District GP-4 (High Density Residential Uses) on approximately a 15.21 acre tract of land generally located east of Line Creek Parkway and north of N.W. Barry Road. (7421-GP-11)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Pat Noll, City Planning, stated that the ordinance approved a residential senior development known as Kendallwood Hills Estates. The plan will allow the expansion of the project from 128 units to 282 units. Councilwoman McFadden- Weaver asked if the wooded area would be cleared. Patricia Noll stated that the wooded area would not be totally cleared that the developer wanted to allow the project to remain wooded where possible. There were comments from Brian Mc Millian and Liz Stickley of Kendallwood Senior Retirement Living Project they expressed excitement about the new development.

Approving the plat of Northview Third Plat, an addition in Kansas City, Clay County, Missouri; accepting various easements; establishing grades on public ways; authorizing the Director of Public Works to execute certain agreements; and authorizing the City Clerk to file this ordinance and attached agreement.

Travis Kiefer, City Planning, stated that this ordinance approved 19 single family units and release various easement, grades and agreements to maintain storm water drains. Councilman Fairfield asked for an explanation of the connecting road to the cul de sac shown on an area map. Travis explained the there were several connections roads that would allow access to major arteries.

Approving the assignment of the development rights for a portion of the One Pershing Square project from Pershing Square Redevelopment Corporation to Gateway Pershing Property, Inc., and then to Group Health Property Company of Kansas City, L.L.C.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS AS A COMMITTEE SUBSTITUTE"
John Eckhart, City Development, stated that the ordinance addresses development rights for a portion of the One Pershing Square project including the assumption agreement, release agreement for Pershing Square Redevelopment Corporation, Gateway Pershing Property Inc. and Group Health Property Company. Representatives from which of the companies listed above agreed that they were in agreement with this ordinance and look forward to the changes.

Ordering the Plaza Library Redevelopment Project improvements to be made and financing therefore to be obtained and stating the Council intention regarding a related matter.

Michaela Hunter, City Development, discussed the Plaza redevelopment. She address the concerns about the project and suggested a substitution to the ordinance to accommodate the interest of the library and the developer. All parties concerned agreed on the changes. John Crosby, Representative for the library stated that he was in agreement with the changes and was looking forward to the completion of the project.

Approving and designating Redevelopment Project IV of the Barry Towne Tax Increment Financing Plan as a Redevelopment Project and adopting tax increment financing therefor.

Representative from EDC explained that the ordinance would allow the capture of sales tax to off set cost of storm water drainage system and the maintenance.

Approving a General Development Plan for the 41st & Paseo Redevelopment Planning Area for an area of approximately 7.15 acres generally bounded by E. 41st Street, The Paseo, Wayne Avenue, and E. 42nd Street, declaring the area included in such plan to be a blighted area, insanitary or undeveloped industrial area and its redevelopment necessary and approving the ad valorem tax benefits.

RESOLUTION - Amending the Red Bridge N.W. Land Use Plan by amending the Proposed Land Use Plan and Map for approximately 1.12 acres generally located in an area north of the termination of E. 108th Street, east of State Line Road and approximately 600 feet south of Carondelet Drive by changing the recommended land uses from commercial (.35 FAR) and hotel/office/institutional (.43 FAR) to office and institutional, and amending the development guidelines to that plan. Virginia Wolf, City Planning, testified that items 031041,031042 and 031154 were companion ordinance that amended the Red Bridge land use from office use to institutional use. All parties involved satisfied with the changes.

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0515, rezoning an area of approximately 22 acres generally located on the south side of Carondelet Drive, extending from State Line Road east to Glen Arbor Road from Districts R-1a (One-Family Dwellings) and PD/R-5, R-1a (Planned District/High Apartments, One-Family Dwellings, Medium Density) to PD/R-5, R-1a, (Planned District/High Apartments, One-Family Dwellings, Medium Density), and approving a development plan for the same. Amending Section 80-446, Auxiliary parking, to eliminate the requirement of Board of Zoning Adjustment approval of parking already approved in a plan, and changing the requirements regarding distance between the parking lot and the business district.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS AS A COMMITTEE SUBSTITUTE"
Larry Stice, City Development, explained that the ordinance eliminate the requirement for the distance of parking from a building. Due to the lay of the property it would be difficult if not impossible to meet the required distance. The developer has requirement a waiver and the Board of zoning and adjustments has agreed. Staff recommends approval.

Vacating the north-south alley east of Main Street from the south line of Grand Boulevard to the north line of Warwick Trafficway and directing the City Clerk to record certain documents. (1445-V)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Larry Stice, City Development, explained that the ordinance would vacate and area near Grand Boulevard and Main. It appears to be a routine vacation and staff recommends approval.
 
 There will be a closed session to discuss a Real Estate Transaction pursuant to RSMo. 610.021 (2).
