| Adopting the Show Me Green Sales Tax Holiday for City sales taxes on Energy Star certified new appliances from April 19 through April 25, 2011; and directing the City Clerk to provide a certified copy of this ordinance no later than March 1, 2011, to the Missouri Department of Revenue as notice of the City's participation in the sales tax holiday.
FINANCE AND AUDIT COMMITTEE recommends "DO PASS" Dennis Murphey, Environmental Office, stated that this ordinance would allow the City of Kansas City, Mo. the opportunity to participate in the Missouri Sales Tax Holiday. The city had participated in most of the previous years. The paperwork for the 2009-10 period were not filed in time for the City to participate last year.
The holiday exempts shoppers from paying sales tax on energy efficient appliances for the period in question. Kansas City was one of a few cities in the metro area that participates in the holiday.
Councilmembers asked about the impact of the loss of the sales tax to the city.
Mr. Murphey and Mark Thoma-Perry stated that there had been attempts to get a breakdown of that information from the state but none was available. Mr. Thoma-Perry was sure that there was minimal impact to the city. Ayes: 3 - Funkhouser, Sanders Brooks, Gottstein Nays: 0 |

| Appropriating $3,000,000.00 from the Unappropriated Fund Balance of the Legal Claims Fund.
FINANCE AND AUDIT COMMITTEE recommends "ADVANCE AND DO PASS, DEBATE" Mark Thoma-Perry, Office of Management and Budget explained that funds had accumulated in the Legal Claims fund over the last few years and are now being appropriated to cover expenses and claims through the end of this fiscal year. | 100985 (Sub.) | Amending Article VI of Chapter 2, Code of Ordinances, entitled “Boards, Commissions and Committees”, by enacting in lieu thereof one new section, Section 2-721.1 which incorporates a Missouri Constitutional provision concerning state residency into the City’s Code of Ordinances for City appointments to certain boards, commissions, and authorities, and requires the City Clerk to annually notify other appointing authorities and community improvement districts of this Constitutional provision.
FINANCE AND AUDIT COMMITTEE recommends "DO PASS AS A SECOND COMMITTEE SUBSTITUTE" Councilman Russ Johnson stated that the questions raised by the committee over the last few meetings had been addressed and staff was ready to move forward with the ordinance. The language had been revised to address exceptions to the ordinance. The reason for the ordinance was to hopefully avoid future lawsuits from being filed against the city for violation of the Missouri State Constitution with regards to residency requirements for board and commission members.
Councilmembers still had questions about nonresident board members currently serving on a board or commission. One major concern was what happens to members already serving if the ordinance passes.

| | | Consideration of Semi-Annual Docket Items.
The following items were recommended for release by the Finance and Audit Committee:
090950, 090983 (Sanders Brooks voted nay for release), and 100223.
The Monthly Financial Report for the period ended December 31, 2010 will be presented.
Gary Morris, Finance Department, presented the report for December, 2010. According to Mr. Morris expenditures were down compared to the same period last year. Revenues are basically flat.
The real estate/personal property are showing a slight increase. He stated that he couldn't tell if it was due to a timing issue or if revenues were based on a tax increase. He referred to Mark Thoma-Perry, Acting Budget Officer, for an answer. Mr. Thoma-Perry stated that the department would evalute the information found in the report and compile information to give to the council. He wasn't quite sure when that information would be available. Councilwoman Hermann stated that she would like to see the information submitted to the council before the budget is approved in case adjustments to the new fiscal year budget were needed.
There will be a Budget Update.
There may be general discussion(s) on current Finance and Audit Committee issues.
Pursuant to the following subsections of Section 610.021 of the Revised Statutes of
Missouri, there may be a closed session to discuss:
(1) legal matters, litigation, or privileged communications with attorneys, pursuant to
subsection 1;
(2) real estate, pursuant to subsection 2;
(3) personnel, pursuant to subsection 3 and 13;
(4) sealed bids or proposals, pursuant to subsection 12; and/or
(5) negotiations with employee groups, pursuant to subsection 9.
The City Clerk's Office now has equipment for the hearing impaired for use with every meeting. To check out the equipment please see the secretary for each committee. Be prepared to leave your Driver's License or State issued Identification Card with the secretary and she will give you the equipment. Upon returning the equipment your license will be returned.
