Amending Chapter 2, Code of Ordinances, repealing Section 2-1189, Board of trustees, and enacting in lieu thereof a new section of like number and subject matter.


FINANCE AND AUDIT COMMITTEE recommends "DO PASS"
Greg Williams, Mayor's Office, testified on behalf of this ordinance. This ordinance would give the Mayor the option to appoint a council member as the ex-officio member of the Board of Trustees.

Reducing an appropriation in the Capital Improvements Fund in the amount of $180,000 and appropriating this sum to an account in the Capital Improvements Fund for the Indian Creek Trail and a FOCUS Center in the Sixth Council District .

Pat Kline, Public Works Department, testified on behalf of this ordinance. This ordinance would authorize the 6th District Council members to use funding from their neighborhoods to construct the new FOCUS Center that will be located on 99th and Holmes.

Approving and authorizing settlement of a workers compensation claim filed by Kenneth S. Olds for injuries resulting from an accident on February 23, 2002, while employed by the City.

Changing the dates and times for the standing committee meetings and legislative and business sessions for the week of November 24, 2003 and cancelling the City Council standing committee meetings and legislative and business sessions scheduled for the week of December 9, 2003.

Councilman and Chair of Committee Charles Eddy, testified on behalf of this ordinance. This ordinance would allow for no Council Committee Meetings or Legislative Sessions during the weeks of November 24, 2003 (Thanksgiving) and December 8, 2003 (NLC).

RESOLUTION - Expressing the CouncilĀ“s interest in issuing revenue bonds in an amount not to exceed $60,000,000.00 for the purpose of allowing Endur Corporation to purchase equipment and develop an underground campus facility to house data backup equipment for large companies in leased space within the Subtropolis facility located at 8300 N.E. Underground Drive; and directing the City Manager to work with the Economic Development Corporation to negotiate a plan to accomplish the project.

Amending Article VIII, entitled Sales Tax of Chapter 68 of the Code of General Ordinances of Kansas City, Missouri, as amended, entitled by enacting a new section thereof, designated as Section 68-473, imposing a tax for general revenue purposes on all sellers for the privilege of engaging in the business of selling tangible personal property or rendering taxable services at retail at the rate of one half percent (0.5%) per tax on the receipts from the sale at retail of all tangible personal property or taxable services at retail within said City, if such property and services are subject to taxation by the State of Missouri under the provisions of Sections 144.010 to 144.525, RSMo., pursuant to the authority granted by and subject to the provisions of Sections 94.600 to 94.655, RSMo., dedicating all of the proceeds of such tax to transportation purposes, improvements and maintenance subject to the provisions of Sections 644.032 to 644.033, RSMo., and providing for submission of this ordinance to the qualified voters of the City for their approval on the next available election date as may be provided by law.


FINANCE AND AUDIT COMMITTEE recommends "ADVANCE AND DO NOT PASS"
Galen Beaufort, City Attorney, testified on behalf of this ordinance. This ordinance would authorize the mayor and council to send to the Election Boards (Clay, Platte, Cass and Jackson) an ordinance for the voters of the City of Kansas City, Missouri to vote regarding a Public Transit System. The Law Department recommended to the committee to "Advance And Do Not Pass" the ordinance from the committee and for the full council to fail the ordinance. There are several recommendations that the council could act upon. They are: 1. Adopt the ordinance as is (Mayor and Council). 2. Modify the ordinance; change the ordinance so that it would pass. 3. Do nothing to the ordinance, or 4. Pass the Initiative ordinance in the form it was presented to the council. The Law Department recommends number four. Council fail the ordinance. The Committee of Petitioners will then have to file with the City Clerk's Office a Certificate stating the ordinance to be sent to each one of the Election Boards and to be placed on the next available election ballot. Mark Huffer, ATA, spoke regarding the ordinance. A copy of his statement is on file in the City Clerk's Office.
 
 There will be a closed session to discuss legal matters pursuant to RSMo 610.021(1).
 
 There will be a closed session to discuss a Personnel Matter pursuant to RSMo 610.021(3).
