Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0234, rezoning an area of approximately 90 acres generally located on the east side of N. Stark Avenue, approximately 1,200 feet north of N.E. 112th Street, from District RA (Agricultural) to District R-1a (One-Family Dwellings). (12326-P)

Virginia Walsh, City Development, gave an overview of the ordinance. Ordinances 991238 and 991239 are companion cases. Ordinance 991238 is to rezone 90 acre tract of land to allow 262 single family residential lots and 15.34 acres of public park land dedication. Ordinance 991239 will approve a preliminary plat for the creation of lots. City Plan Commission and staff recommended approval. Art Akin, representing the applicant concurred with staff's recommendation.

Lee Dixson, Public Works Department, gave an overview of the ordinance. Approval of the plan will create 10 residential lots. All of the grades and closures have been checked and he recommended approval.

Lee Dixson, Public Works Department, said that the plat is for a seven lot residential development. The developer was required to submit a storm drainage study to obtain a land disturbance permit. All of the grades and closures have been checked and he recommended approval. Councilwoman Cooper expressed concerns regarding drainage and flooding problems. Mr. Dixson answered Councilwoman Cooper's concerns. Councilman Ford requested that the ordinance be held for one week for further clarification of the drainage problems.

Estimating revenue in the amount of $5,000.00 in the Mo. Dept of Conservation-Tree Planting account of the General Fund; appropriating it to the MDC-Tree Planting account; and authorizing execution of a $5,000.00 agreement with the Missouri Department of Conservation for the "Branch Out Missouri" Program for the receipt of funds for tree planting on the public right-of-way along Southwest Boulevard fronting the Westside Business Park.

RESOLUTION - Approving the Troostwood Neighborhood Plan as a guide for the future development and redevelopment of the area bounded by Volker Boulevard on the north, Paseo Boulevard on the east, Rockhurst Road on the south and Troost Avenue on the west.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "IMMEDIATE ADOPTION AS A COMMITTEE SUBSTITUTE"
Councilman Rowland gave a briefing on resolutions 991199 and 991200. He stated that the resolution has been an ongoing planning effort by the Troostwood area and City Planning Department for some time. There was some concern regarding a specific piece of the plan which deals with Rockhurst Road street scape and buffer, which has been taken out the plan. Rockhurst has been contacted and agreed with the changes. Resolution 991200 incorporates the Troostwood plan into the Plaza plan and include area C (Van Tyle project). A committee substitute was submitted on the ordinance which will amend the plaza plan back to its original form. Councilman Ford asked for clarification on resolution 991199. Councilman Rowland answered Mr. Ford's concerns. Mark McDowell, 906 W. 48th Street, KCMO, stated that there are two objectives: (1) that the development contains more parking places that are required by the development itself; (2) that the development conforms to the FOCUS plan for the urban core particularly for the central business corridor. The current plaza plan does conform with the FOCUS plan. He stated that he opposes the change. The FOCUS plan for the central business corridor encourage density of development and density of activity. Several area residents spoke in support of the plan.

RESOLUTION - Approving an amendment to the Plaza Urban Design and Development Plan for the future development and redevelopment of the areas generally bounded by 43rd Street on the north, Paseo Boulevard on the east, 55th Street on the south and State Line Road on the west by changing the land use recommendations for Planning Area C which is bounded by 48th Street on the north, Roanoke Parkway on the east, Ward Parkway on the south and Belleview Avenue on the west and for Planning Area L which is bounded by 49th Street on the north, 51st Street on the south, Forest Avenue on the east and Troost Avenue on the west.
