Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0022, rezoning an area of approximately 2.7 acres generally bounded by 48th Street on the north, Ward Parkway on the south, Roanoke Parkway on the east and Belleview Avenue on the west from Districts R-4 (Low Apartments) and R-4-O (Low Apartments, Administrative Office Buildings) to District URD (Urban Development District); approving a development plan for the same; calling an election for November 3, 1998, to submit these matters for consideration by the voters; directing the City Clerk to notify the responsible election authorities of the election being called no later than August 25, 1998; and recognizing this ordinance to be an emergency measure.

Ordinances 970035, 971294 and 971295 are companions. Patty Noll, City Development stated the purpose of hearing the ordinances are to outline the revisions of the Brush Creek Plaza Development plan. The Mayor and City Council directed staff to conduct a series of workshops, with representatives of the neighborhood, developer and city staff. The intent was to design a mix use project including residential/office and retail uses that would be compatible with the Plaza. The ordinances were held off the agenda for several month. In November 1996 the City Plan Commission denied a request to rezone the property, also denying a Plaza plan amendment. In January 1997 ordinances to amend the plaza plan and rezone the property were introduced. Aaron March, Attorney outlined the changes between the zoning plan that CPC considered and the T IF plan considered by the TIF Commission along with the plan that came out of the series of meetings. He gave a detail overview of the revised plan and cost implications. Committee recommended to hold the ordinances for two weeks.

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0145, rezoning an area of approximately 8.0 acres generally located at the southeast corner of 29th Street and Wheeling Avenue from Districts M-2a-p (Heavy Industry - Limited District), R-2b (Two-Family Dwellings) and M-2a (Heavy Industry) to District M-2a (Heavy Industry). (8234-P-1)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "DO PASS"
Larry Stice, City Development gave overview of the ordinances. Ordinance 980445 and 980446 are companions. Ordinance 980445 will rezone from District M2ap, R-2b and M-2ap to District M-2a. Ordinance 980446 will approve a development plan to allow a 20,222 square foot building addition and construction of a 30,000 square foot building. Staff believes that the current access thru residential is not appropriate, because of the narrow street and open ditches. Therefore, recommended that the new access drive to the west of the development be constructed with the first phase of the project. Steve May, applicant concurs with staff's recommendation. Councilmember Mary Williams-Neal, stated she had visited the site and was very impressed and supports the rezoning. Committee recommended approval.

Lee Dixson, Public Works Department, stated the ordinance will approve the plat of Somerset Gardens for a residential development. All of the grades and closures have been checked. Committee recommended approval.

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0137, rezoning an area of approximately 8.84 acres generally located at the southeast corner of E. 41st Terrace and Blue Ridge Cutoff from Districts C-2-p (Local Retail Business - Limited District) and R-1a (One-Family Dwellings) to District CP-2 (Local Planned Business Center), and approving a preliminary plan for the same. PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS"
Larry Stice, City Development stated the ordinance is for a rezoning and development plan on the east side of Blue Ridge Cutoff. The ordinance was previously presented to the committee some weeks ago, and at that time there were four buildings, two hotels and a convenient store. Since that time the convenient store has been deleted, the other buildings still remain on the plan. Aaron March, Attorney, stated the plan is a improved, A larger area of green space has been created between all of the buildings. He showed the committee a revised plan. Mr. Patel, applicant concurred with the revised plan and in agreement with staff's recommendations. Councilmember Bacchus stated that the plan is a much improved one. He's worked the developer and the developer's attorney on the plan. Committee recommended approval of the ordinance.
