Amending Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 80-11A0026, rezoning an area of approximately 1.43 acres generally located at 12309-19 State Line Road from District C-1 (Neighborhood Retail Business) to District C-2-p (Local Retail Business - Limited District), and approving a preliminary plan for the same. Carrie Flack, City Development, gave a complete overview of the ordinance. The purpose of the ordinance is to allow for the opening of a cocktail lounge. Jim Bowers, Polsinelli & White, representing the applicant stated that letters were sent to each committee member regarding the project which included certain documents. A petition signed by 244 people in support of the application. Several business owners and residents spoke in favor of the project. Councilmember Asjes expressed concerns regarding parking. He also asked if the proposal included heavy "Streaming" or "Berming". Carrie explained to the committee. Mark White, Attorney, Freilich, Leitner & Carlisle Law Firm, represeting Academy Montessori Internationale, presented the committee petitions of those residents in opposition to the ordinance. The issue is whether the zoning is appropriate for a residential area. The Montessori school has been at the present location since 1986. Mr. White gave several objections to why rezoning should not take place. Traffic issues are also a concern among the residents in the area. There is a 300 feet requirement between a tavern and a school. C. Woods, Administrator of the Montesorri School, spoke in opposition of the rezoning, because of safety issues. Several area residents spoke in opposition of the rezoning. Jim Bowers, stated staff has reveiewed the application and recommends it be approved. City Plan Commission has recommended approval. Committee recommends holding the ordinance for two weeks.

Oak Trafficway on the west, N. Woodland Avenue on the east, Interstate 435 on the north, and N.E. Cookingham Drive on the south from District RA (Agricultural) to District R-1a (One-Family Dwellings). (11892-P)

RESOLUTION - Approving an amendment to the Plaza Urban Design and Development Plan for the future development and redevelopment of the area generally bounded by 43rd Street on the north, Paseo Boulevard on the east, 55th Street on the south and State Line Road on the west.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "BE ADOPTED AS A COMMITTEE SUBSTITUTE"
Lisa Briscoe, City Development stated the committee requested that a plan amendment be done. A new revised fact sheet was presented. She gave a complete overview of the changes. Councilmember Glover expressed concerns regarding parking. Briscoe, stated she has met with the Traffic Division last week regarding this issue. Mike White, Attorney, gave an update of the overall view of the Plaza Plan, and discussed the building height and how the plan is fits the "bowl concept". Steve McDowell, Architect, gave an overview of the landscape and architectural design. Dan Cofran, Attorney, (representing property owners) stated that both staff and CPC recommends denial of the project. The rezoning is not appropriate for the site. A reason should be given as to why the Plaza plan should be changed. He urged the committee to follow the recommendations of staff and CPC. He suggested that in the staff report on page 8, paragraph 4 be stricken from the report (see staff report). Several area residents spoke in opposition of the plan. A committee substitute was submitted. Committee recommends approval of the resolution.
