Authorizing the City Manager to execute a fourth amendment of a contract with the Neighborhood Housing Services of Kansas City to enlarge the term of the contract and to further the EnergyWorks KC program.


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "ADVANCE AND DO PASS, DEBATE"
Dennis Morphy, Chief Environmental Officer, and Gerald Shechter, Office of Environmental Quality, gave the staff report on the Ordinance. It was noted that this is a companion ordinance with 140195. The purpose of the contract with Neighborhood Housing Services of KC, Inc. (NHS) is to support the EnergyWorks KC initiative goals by providing funds to reduce the effective interest on loans for energy efficiency improvements citywide. DOE guidelines for a Interest Rate Buy-Down Fund (IRBD) requires that these funds be used in perpetuity for the purpose for which they were obligated. The total commitment from EECBG to capitalize the IRBD Fund remains unchanged at $1 million ($1,000,000.00). No additional compensation is provided for NHS to manager the loan fund. The total contract, including management fees, remains at $1,030,500.00. Termination date of the contract is extended from the current date of March 31, 2014 to a new termination date of April 30, 2015.

John Eckardt, City Planning and Development, gave the staff report on the ordinance. Mr. Eckardt testified that there are two cases involved with this Ordinance. The first is an area plan amendment. The second is a rezoning to District MPD with a plan. These two actions need to be taken so the applicant can construct an Advanced Auto Parts store (and also other future improvements) on the southwest corner of Independence Avenue and Chestnut Avenue.

Approving a Development Plan which also serves as a preliminary plat, on about 3.42 acres generally located on the west side of Elmwood Avenue between E. 38th Street on the north and E. 39th Street on the south, in zoning District R-1.5 to allow for three tracts containing 10 structures (20 duplex units) and public street. John Eckardt, City Planning and Development, gave the staff report on the Ordinance. The site is about 3.4 acres and lies west of Elmwood Avenue, between E 38th Street on the north to E 39th Street on the south. The site is vacant of improvements but has been platted into a series of 40 foot wide lots suggesting single family detached residential development in the past. The site currently contains volunteer trees and shrubs. According to the plan the site slopes from north to south with nearly a 30 foot drop in elevation in the over 500 foot distance between E 38th Street and E 39th Street.

Authorizing the City Manager to execute a fourth amendment of a contract with the Neighborhood Housing Services of Kansas City to enlarge the term and increase the total amount of the contract up to $3,696,417.00, all to further the EnergyWorks KC program.

Dennis Murphey, Chief Environmental Officer, and Gerald Shechter, Office of Environmental Quality, gave the staff report on the Ordinance. It was noted that this is a companion ordinance with 140188. The purpose of the contract with Neighborhood Housing Services of KC, Inc. (NHS) is to support the EnergyWorks KC initiative goals by providing reduced interest loans for energy efficiency improvements citywide. NHS will originate loans based on referrals from the Metropolitan Energy Center (MEC) and other sources. Federal guidelines for a Revolving Loan Fund (RLF) requires that these funds be used in perpetuity for the purpose for which they were obligated. The City is liquidating available balances in the EnergyWorks KC grant program, which terminates March 31, 2014, to provide additional funds to the already established RLF. The total commitment from EECBG to capitalize the Revolving Loan Fund is increased by $450,000.00 to $3,450,000.00. No additional compensation is provided for NHS to manager the loan fund. The total contract, including management fees, is increased from $3,246,417.00 to $3,696,417.00. Termination date of the contract is extended from the current date of March 31, 2014 to a new termination date of April 30, 2015.

Brad Wolf, City Planning and Development gave the staff report on the Ordinance. It has been determined by staff that certain clarifications should be made to the text of Sections 88-580 Historic Designations, 88-585 Certificates of Appropriateness, and that a definition should be added to 88-810. 1) For an application for historic designation that is denied and subsequently appealed, current text does not specify who would hear the appeal to the decision of the historic preservation commission. 2) Adds that all applications for historic designation, regardless of the decision of the Historic Preservation Commission, must be forwarded to the City Plan Commission and City Council for review. Under current practice, designations that are not recommended for approval by the Historic Preservation Commission are not subsequently forwarded to CPC and Council. Similarly, proposed text states that if a request for rehearing is granted, the recommendation of the Historic Preservation Commission after the rehearing, regardless of the recommendation, must be forwarded to the City Plan Commission and Council for review. 3) Definition of “Administrative Official” added. 4) Consistent with other procedures, text revised to specify that mailed notice must be sent at least 13 days before the scheduled hearing.
