Amending Ordinance No. 000866, by repealing Article 3.2 of the Supplemental Retirement Plan and enacting in lieu thereof a new article of like number and subject matter.


FINANCE AND AUDIT COMMITTEE recommends "ADVANCE AND DO PASS, CONSENT"
Gary O'Bannon, Director of Human Resources, testified that this ordinance would allow the City to suspend contributions to 401 plans for the new fiscal year. The IRS has been notified of the suspension of contributions.

Amending Article VIII of the Administrative Code of Kansas City, Missouri relating to the Classification and Compensation Plan, by repealing Sections 2-1075, 2-1076, 2-1077, 2-1078, 2-1079, 2-1080, 2-1081, 2-1082, 2-1083, 2-1086, and 2-1099, and adopting in lieu thereof new sections of like numbers which sets the new salaries for the Mayor, Council Members and Judges; increasing the maximum salaries of the pay grades by one percent for M-class non-exempt, exempt and those pay grades covered by the Memorandum of Understanding between the City of Kansas City, Missouri and Local 500, American Federation of State, County and Municipal Employees; allowing for one additional day of vacation for certain individuals with twenty or more years of continuous years of service; implementing the second year of the pay grade and step changes in accordance with the MOU with Local Union 3808 of the International Association of Fire Fighters; freezing pay or incentive increases for all unrepresented employee groups; and establishing an effective date.

Gary O'Bannon, Director of Human Resources, testified that this ordinance was to amend the section of Chapter 2 that deals with the memorandum of understanding between employee's unions and the City of Kansas City, Mo. Contract negotiations have been finalized with several unions and this ordinance would put negotiated clauses into effect. Mr. O'Bannon stated that the only increases in wages were those dealing with cost of living increases but there were no salary increases based on merit. Several council members were concerned about the impact the contracts would have on the annual budget for the year.

Approving execution of the First Amendment to the Cooperative Agreement for Design and Construction with the Performing Arts Community Improvement District, and others, for excavation and design work necessary for the construction of the Parking Garage adjacent to the Performing Arts Center.

Amending Chapter 2, Code of Ordinances, by enacting a new section regarding transfer of funds.


FINANCE AND AUDIT COMMITTEE recommends "ADVANCE AND DO PASS AS SECOND COMMITTEE SUBSTITUTE, DEBATE"
Rich Noll, Assistant City Manager, explained that this ordinance had previously been discussed and that the changes requested had been included in this version of the ordinance. The original ordinance put a cap on the amount of funds that could be transferred without council approval. The Budget Office would be sending council a monthly report on all transfers of funds for their review.

 EDC will give a presentation on Small Business. This item was held one week. Staff from the City Auditor's Office will present the Performance Audit: Minority and Women Business Enterprise Program. Gary White, City Auditor, presented the finding of the audit to the committee. Information presented indicated serious problems with the program. (A copy of the report is on file in the Office of the City Clerk.) Human Relations Director Philip Yelder was prepared to respond to the audit findings. Councilwoman Hermann asked that he return in three weeks to address the issues raised in the report. Budget Implementation discussion. Mary Charles, Communications Manager, made a presentation before the committee about the need for increasing the funding allocated to the section in the 2009-10 annual budget. She stressed the importance of continuing the job the staff was performing currently. She outlined duties that staff had been providing for free to various departments and outside agencies. A copy of the presentation is on file in the Office of the City Clerk. Ms. Charles also stated that she was confident, given the opportunity, the division could secure enough contractual work to keep the office and staff in tact and running. Council members stressed that while the office was vital to getting information out to the public, they didn't want to see any departments redirecting essential services dollars to communications. The committee wanted staff to come back with signed MOUs within the next two weeks. City Manager Cauthen stated that he would work with the Communications Office in the task of securing commitments from other departments in the form of MOUs and have them back before the committee before the beginning of the new fiscal year. Troy Schulte, Budget Officer, gave a brief report on Structural Budget changes for fiscal year 2009-10. The structural changes were based on employee activity and nonstructural changes to the budget dealt primarily with infrastructure and sales tax obligations. A handout showing changes and reductions is on file in the Office of the City Clerk. There may be general discussion(s) on current Finance and Audit Committee issues. Pursuant to the following subsections of Section 610.021 of the Revised Statutes of Missouri, there may be a closed session to discuss: (1) legal matters, litigation, or privileged communications with attorneys, pursuant to subsection 1; (2) real estate, pursuant to subsection 2; (3) personnel, pursuant to subsection 3 and 13; and/or (4) sealed bids or proposals, pursuant to subsection 12.
