Dr. Archer, Health Department, explained that the ordinance would allow authorization to enter into a contract with the Office of Healthy Homes and Lead Hazard Control to provide lead hazard remediation to families with young children and property owners with tenants with young children.

Amending Chapter 10, Code of Ordinances, by repealing section 10-263, Transfer of location, and enacting in lieu thereof a new article of like number and subject matter which will require that the provisions of section 10-211, Number of Retail Alcoholic Beverage Licenses, must be met and will not allow for the transfer of a convention trade area 3:00 a.m. closing permit.

Amending Chapter 10, Code of Ordinances, by repealing Sections 10-1, Definitions, and 10-211, Number of retail alcoholic beverage licenses, and enacting in lieu thereof new sections of like number and subject matter which adds the definition of a Kansas City Population Update Report and under 10-211(3) adds the option for an applicant to request a Kansas City Population Update Report in place of the most recent U.S. Decennial Census as the Kansas City Population Update Report may provide a more up to date report of the population in the requested area.


PUBLIC SAFETY AND NEIGHBORHOODS COMMITTEE recommends "HOLD ON AGENDA (2/6/2008)"
Ed Ford, Ordinance Sponsor and a representative from Regulated Industries explained that growth in the northland has brought this ordinance about because part of licensing is based on population. This would allow more alcoholic beverages licenses. The committee expressed concern are having the reverse issue (to many liquor licenses).The Committee requested an information update from Regulated Industries on the issue. Dr. Rex Archer supports the update because he believes that it will effect the health of citizens if not addressed.

Accepting funds allocated by the U.S. Department of Justice, Bureau of Justice Assistance, Office of Justice Programs, FY 2007-08 Byrne Justice Assistance Grant (JAG) in the amount of $919,020.00; estimating revenue in the amount of $919,020.00 in the General Fund; appropriating it to the 2007-08 Justice Assistance Grant account in the General Fund; authorizing cooperative agreements with the Board of Police Commissioners ($243,540.00), City of Grandview ($27,570.00), City of Independence ($101,092.20), and Jackson County Prosecutors Office ($303,276.00); directing the City Clerk to file certain documents with the appropriate offices.

Reducing an appropriation for the City Development Department by $111,352.00 and appropriating $111,352.00 to the Neighborhood and Community Development Department for contracting with Operation Breakthrough for the provision of day care services.

Jackie Powell, explained that the ordinance would cover cost for transportation for operation breakthroughs daycare children including the bus purchase, maintenance and salaries for bus drivers.

Amending Chapter 10, Code of Ordinances, by repealing Section 10-291, Generally, and enacting in lieu thereof a new section of like number and subject matter which updates the ordinance as to the fee assessment for an employee liquor permit and corrects the alphabetical organization.

Gary Major, Regulated Industries, explained the additional fee request in this ordinance. Sanders-Brookes asked what the fee was $20-$60). Bill Nigro, Business Rights Coalition thinks that the fee increase is to high and stops some working poor from taking these jobs. Councilman Sharp stated that he agreed that it is a difficult process. Jason ?, also expressed concern that the process is to long and costly. Circo suggested that the update should included the "path to employment".

Calling for submission to the voters of Kansas City, at a special election to be held Tuesday, February 5, 2008 a question amending Chapter 34, Code of Ordinances, by repealing Article XII, Smoking prohibited in enclosed places of employment and public places, consisting of Sections 34-471 through 34-481, and enacting in lieu thereof a new article of like name and subject matter consisting of Sections 34-471 through 34-481, prohibiting smoking in enclosed places of employment and enclosed public places and ; establishing penalties for noncompliance; authorizing and directing the City Clerk to notify the responsible election authorities of this election; and recognizing this ordinance to be an emergency measure.

Accepting and approving a one year $85,500.00 grant from the Missouri Department of Health and Senior Services to provide services for the Women's Infant and Children's nutritional program (WIC); estimating revenue in the amount of $28,500.00 in the Governmental Grants Fund; appropriating it to the WIC Nutritional Program account of the Governmental Grants Fund; designating requisitioning authority; and recognizing an emergency.


PUBLIC SAFETY AND NEIGHBORHOODS COMMITTEE recommends "ADVANCE AND DO PASS, DEBATE"
Dr. Archer and Judy Moore-Nichols of the Health Department along with Sis. Coretta of Operation Breakthrough were present to testify on the ordinance. The ordinance would provide for additional WIC nutrientional care services to be provided through the Health Department. There was a general concern that in the past the Health Department had declined to provide the services and there were some issues regarding efficient. Additional concerns were wether the Health Department was duplicating services and if they could now run the program efficiently. Sis. Coretta stated that the additional services were needed. Operation Breakthrough has identified that a large percentage of their clients were not being served. The Committee recommended Advance and do pass.

 OMB will give a report on the Court plan and information on the "Improvement Plan for Municipal Courts". There was no report from OMB. There may be general discussion of Public Safety and Neighborhood Committee issues. There may be a closed session pursuant to Section 610.021(1), (2) and (3) RSMO to discuss legal matters, real estate or personnel matters.
