Staff has requested that a final plan showing landscaping and signage be submitted. Staff & City Plan Commission recommended approval. Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0376, rezoning an area of approximately 42.3 acres generally located on the south side of East 56th Street, approximately 500 feet west of Bennington Avenue (6309 East 56th Street) from District R-2b (Two-Family Dwellings) to District RA (Agricultural). (7389-P-3)


PLANNING, ZONING & ECONOMIC DEVELOPMENT COMMITTEE recommends "HOLD ON AGENDA"
Ordinances 011121 and 011122 are related cases. Tim Parks, City Development Department, stated that the rezoning is located on the south side of East 56th Street and on the west side of Bennington Avenue. The project is currently zoned as R-2b with a 1150 foot high commercial television tower. The applicant is proposing to rezone the property from R-2b to PD/RA to allow for the existing tower to be deconstruction after a new 1162 foot high tower is erected. The applicant is replacing the tower in order to conform to Federal Regulations requiring commercial television tower to be capable of accommodating both digital and analog broadcasting capacity. None of the other improvements on the site are proposed to change. Currently there is a shelter on the property which houses equipment for the tower. Staff and City Plan Commission recommended approval subject to certain conditions. Sherwin Epstein, Attorney, stated that the project is called "raise and rebuild" the tower will be newer and up to date. A brochure of the tower was shown to the committee. Shawn Stewart, King, Hershey Law Firm, representing American Tower. He stated that his client opposed the request for rezoning, because his clients tower has the capability and capacity to accommodate Richland Towers and it's need for additional broadcasting, therefore, rezoning is not necessary. Although the applicant is proposing the construction of a television tower and not a wireless communication facility, they (American Tower) believe that the two structures are similar in nature. Councilman Ford asked Patricia Jensen (Assistant City Attorney) do the current commercial radio & television transmitting towers have a collocation policy? Patricia answered Mr. Ford's question. John Lewis, 6501 E. 58th Street, Kansas City, Missouri, spoke in opposition of the rezoning because it will degrade the neighborhood. Councilwoman Cooper recommended that the ordinances be held to allow Councilperson from the 5th Council District a chance to review the project.
